  • the incapacity of a citizen, established in the manner determined by the current legislation;
  • the presence of diseases that pose an immediate danger to persons in contact with the carrier.

Application of the professional standard of a preschool teacher

The procedure for applying professional standards, including the teacher's professional standard before school education, is regulated by the provisions of Art. 195.3 of the Labor Code of the Russian Federation. In particular, this section of this legal document establishes that the application of a particular occupational standard is mandatory if such a requirement is established by the Labor Code or other applicable regulations.

At the same time, professional standard preschool teacher does not apply to such documents, which means, within the meaning of paragraph 2 of Art. 195.3 of the Labor Code of the Russian Federation, its application is advisory in nature. In particular, this article suggests that employers use it to develop and establish their own qualification requirements for preschool education workers.

Use of a professional standard in case of insufficient qualification of an employee

The current regulatory documents do not consider the discrepancy between the level of qualification or knowledge of the employee professional standard requirements as grounds for his dismissal. At the same time, in practice, such a discrepancy can create a real problem for an employer who requires certain professional characteristics from a given employee. In this situation, it is advisable to pay attention to paragraph 2 of part 5 of Art. 47 federal law dated 12/29/2012 N 273-FZ "On Education in the Russian Federation", which provides educators with the right to undergo training to improve their skills. At the same time, such training should be organized at least once every three years.

Thus, the professional standard of a preschool teacher is a comprehensive description of the requirements for the professional characteristics of such a specialist, including whether he has special knowledge and skills, education, qualifications, etc. At the same time, however, the employer has the right, at its discretion, to adjust these requirements for the purposes of application in personnel policy, thereby ensuring their maximum compliance with the specifics of the work of their institution. This is due to the fact that professional standard teacher as of 2017 is not included in the list of professional standards that are mandatory for employers.

From January 1, the professional standard of the teacher 2017, approved by the Government of the Russian Federation, is introduced. This is a key document that contains a list of personal and professional competencies of a specialist.

The adopted document will become the basis for the certification of teachers and the assignment of qualification categories. Its norms will be guided when hiring and forming wages. Specifying the knowledge and skills that a teacher should possess, the professional standard reflects it in detail labor activities and separates them into modules.

Professional standard of a teacher: structure

To create all professional standards, there is a single base - a layout that includes the following items:

  1. General characteristics of the profession. Name, activities of employees, classification according to OKVED and OKZ.
  2. functional card. Activity functions.
  3. Characteristic labor functions. Detailed description knowledge, skills and types of actions carried out by specialists.
  4. Information about the organizations- developers.

The structure of the teacher's professional standard is determined by two generalized components:

  • basic ("three whales" of pedagogical activity - training, education, development);
  • additional (project development and implementation educational programs taking into account the characteristics of the teacher's work).

In addition, the professional standard has two additional blocks - "Mathematics" and "Russian language". It follows that, for example, the qualification of a Russian language teacher is determined by five job functions:

  1. Education.
  2. Upbringing.
  3. Development.
  4. Implementation of educational programs.
  5. Block "Russian language".

According to Government Decree No. 584, the transition to the new standards will continue until January 1, 2020. The new professional standard is not a rigidly fixed, “monolithic” document - it allows for the possibility of supplementing requirements depending on regional features and internal standards of educational institutions.

In the meantime, educational organizations should develop a phased plan for the transition to a professional standard.

Professional standard for teachers in 2017: new tasks

The new document introduces five differentiated levels of teacher qualification. They define the requirements for knowledge, skills, abilities and experience that are necessary to perform a job function. The standard also includes a list of professional competencies. For example, for a full-fledged work, a teacher needs to have eighteen basic skills and abilities. Particular attention is paid to inclusive education, support for socially vulnerable and talented students.

It can be said that the modern teacher is assigned the role of a social therapist who is able to recognize pedagogical and even psychological problems child. In cooperation with narrow specialists, the teacher must identify and solve a wide range of problems that the student has.

"Pitfalls" of the introduction of the professional standard "Teacher"

Today there are more than a million teachers in Russia. Some of them are ready to follow the new rules, while others are not. the main problem- no conditions:

  1. Insufficiency of the material base. If the school intends to educate special children, the building must be provided with elevators, ramps, equipped toilets, etc.
  2. Shortage of narrow specialists. In order for a teacher to be able to deal with all students, not only his knowledge, skills and desire are needed. The staff should include psychologists, tutors, sign language interpreters, defectologists and medical workers.
  3. a lack of teaching materials working with students of different categories.
  4. Weak base for training and retraining of teachers.
  5. The absence of an attestation procedure that will allow an objective assessment of the teacher's complicated work and ensure his professional growth.
  6. Overload of teachers. Speaking about the need for a personal approach to each student, one will have to take into account that almost all teachers today work for one and a half to two rates. To meet the requirements of the standard, the load should be no more than twenty hours per week.
  7. Insufficient awareness of representatives of local ministries and departments of education about what is required of teachers today. Managers have minimal knowledge of pedagogy and psychology.
  8. Possibility of deterioration of relations in pedagogical collectives. The emergence of a system of positions (assistant and assistant teacher, teacher, senior and chief teacher, mentor and expert), according to many experts, can negatively affect the education system and lead to an outflow of personnel.\

In the meantime, the school administration needs to develop a plan for a phased transition to the application of professional standards and at the same time take into account all the changes that occurred during 2016. Including the fact that new minister Education and Science Olga Vasilyeva announced a number of innovations in the professional standard of the teacher, as well as the postponement of the date of introduction of this document at the request of the pedagogical community until January 1, 2018.

From January 1 of this year, any teacher must rely on the new professional standard of the teacher 2017 approved by the Government of the Russian Federation. The founding document will replace for all teachers a lot of "unnecessary" and ineffective manuals, instructions and reference books. It was the order of the Ministry of Labor of 10/18/2013 that officially introduced into the work of teachers such a concept of “professional standard”, which everyone who carries out educational activities must comply with. What is a professional standard? For what purpose was it introduced, and how does it coordinate the actions of teachers?

What is a professional standard

The professional standard for 2017 is a document that approves the list of all professional qualities and personal competencies that any teacher, educator, librarian and other education worker must possess. According to this normative act, the entire teaching staff must undergo professional certification, and according to the results, the appropriate qualification level (category) is assigned. The level of competence of a teacher influences the consideration of a questionnaire when applying for a job, the creation of job descriptions, as well as the formation of a teacher's salary.

Russian professional standard contains full list knowledge and professional qualities that should be inherent in every teacher, and also regulates the professional activities of an educator. All labor actions are divided into blocks corresponding to each of the subjects. The government decided to introduce the professional standard gradually, so as not to shock teachers, and give them the opportunity to learn more about the document. Its testing began several years ago in 45 regions of Russia; special internship sites were organized in each educational institution. The Ministry of Education and Science tried to attract as many practicing vocational education workers as possible.

The Minister of Education and Science also introduced the goals pursued by the Government when maintaining new professional standards.

The purpose of the introduction of the document

Starting from 2016, the authorities began to create a register of professional standards for various fields of activity; these regulations describe in detail the level of qualification that each of the employees must meet. By the summer of last year, more than three dozen documents regulating the relevant areas were created, of course, special attention was paid to the field of education. After all, the future of every citizen of the country often depends on the teacher. It is the teacher who lays the foundations of personality in a person.

The main reason for the introduction of professional standards is the lack of a clear structure for determining the professional competencies of employees when assigning a qualification level. After all, the previous norms were only advisory in nature and were not binding when deciding on the assignment of the corresponding category to a teacher. And some instructions in last time updated so long ago that they simply no longer correspond to modern realities.

Of course, the educational professional standard has taken a special place in the register.

Professional standards for teachers in 2017 allow solving the main tasks facing when assigning the appropriate category to an educator:

  • how to provide proper professional training for novice teachers;
  • how to accurately determine the level of qualification;
  • how to notify teachers with all the requirements that will apply to them;
  • how to improve with teachers general level education in the country.

It is the professional standards of teachers in 2017 that will affect:

  • obtaining permission to carry out pedagogical activities;
  • determining the level of remuneration;
  • calculation of teaching experience;
  • calculation of a pension;
  • teacher career development.

New tasks of modern education

The 2017 regulatory document should approve 5 types of qualifications for education workers. The act lists several dozen competencies that a teacher must possess. For example, to perform educational activities, the teacher must be based on at least 18 skills. Starting this year, each teacher will perform not only an educational function, but also be a kind of "social therapist" who is called upon to identify psychological problems in the team. Usually now classroom teacher in the course of his work, he must identify gifted and socially disadvantaged students, and the director is notified in a mandatory form about the presence of "problem" children in the student team.

Thanks to the new professional standards, the main criteria by which teachers are evaluated will be approved: readiness to work with children, ability to communicate on the basis of mutual respect, impeccable command of their subject (for example, a teacher of history and social studies should not only describe what is indicated in the textbook, but also acquaint with rare facts), the ability to explain to students the benefits of self-development and education, as well as independently be an example for the younger generation.

But how will the new resolution affect the formation of wages? Starting from 2013, the Ministry of Education and Science claims that teachers who can confirm compliance with the professional standard will receive an order of magnitude more.

Problems of introduction of professional standards

According to some experienced teachers, the introduction of new professional standards will entail a number of problems, firstly, Russian educational institutions have not yet created the appropriate conditions for the application of these regulations. Secondly, in most schools, especially in sparsely populated areas, there are simply no specialists in narrow areas such as speech pathologists, psychologists, etc. Until the Russian Federation completely changes the structure modern schools, the introduction of such standards will be problematic. Terms of introduction of professional standards

From January 1, 2017, the Order of the Ministry of Labor of October 18, 2013 No. 544n comes into force, which approves the professional standard "Teacher" ("pedagogical activity in the field of preschool, primary general, basic general, secondary general education (educator, teacher)" ). This means that employers (managers educational institutions) are obliged to apply it in the formation of personnel policy and in personnel management, in the organization of training and certification of employees, the conclusion of employment contracts, the development job descriptions and the establishment of wage systems.

So far, two orders of the Ministry of Labor are known that postpone the introduction of professional standards in the educational field: order No. 745 dated December 15, 2016 “On amending the professional standard “Teacher” (which postpones the date of entry into force to September 1, 2019) and the order of the Ministry of Labor dated December 26, 2016 No. 835n “On Amendments to the Professional Standard “Teacher additional education children and adults” (who are postponing the entry of the professional standard to 01/01/2018). The orders, apparently, have not been registered with the Ministry of Justice, so it has not yet been possible to find their texts in the legal databases.

At the same time, Decree of the Government of the Russian Federation of June 27, 2016 No. 584 establishes a transitional period for all professional standards until January 1, 2020. Thus, until the beginning of 2020, the employer, in accordance with the plan for the transition to the professional standard approved by him, selects the document that is to be used in the educational institution. By the end of the transition period, the plans must be implemented, and all teaching staff of the educational institution must comply with the requirements of the professional standard.

It applies to teachers preschool institutions, initial and high school, the system of special education and training.

The professional standard "Teacher" does NOT apply to teachers of additional education, psychologists, tutors, methodologists.

Responsibility for non-application of the professional standard

Responsibility for non-compliance with the requirements of professional standards is established by Art. 5.27 of the Code of Administrative Offenses of the Russian Federation “Violation of labor legislation and other regulatory legal acts containing norms labor law". In accordance with the provisions of the article, liability for a single violation is established in the form of a warning or an imposition administrative fine for officials in the amount of 1,000 to 5,000 rubles, and for legal entities from 30,000 to 50,000 rubles. In case of repeated violation, officials may be fined in the amount of 10,000 to 20,000 rubles. or disqualification for a period of 1 to 3 years. For legal entities, the fine increases to 50,000 - 70,000 rubles.

Feature of the terminology used

Under the qualification of an employee in Art. 195.1 of the Labor Code of the Russian Federation is understood as the level of knowledge, skills, professional skills and work experience of an employee. In turn, the professional standard is a characteristic of the qualifications necessary for the employee to carry out a certain kind professional activity, including the performance of a certain labor function.

In accordance with Decree of the Government of the Russian Federation of January 22, 2013 No. 23 “On the rules for the development, approval and application of professional standards”, the Ministry of Labor and Social Protection of the Russian Federation coordinates the development of standards (clause 2). Professional standards are applied by employers in the formation of personnel policy and in personnel management, in the organization of training and certification of employees, the development of job descriptions, the pricing of work, the assignment of tariff categories to employees and the establishment of wage systems (clause 25).

Order of the Ministry of Labor dated April 12, 2013 No. 148n “On Approval of Qualification Levels for the Development of Draft Professional Standards” approved the description of nine employee qualification levels. Level 5 (for educators) and Level 6 (for teachers) apply to teaching staff.

For each labor function in the professional standard, a code number is used. It consists of two components: letter designation and digital. The letter means the generalized labor function, and the figure means the labor function. The labor function, in turn, includes three components: labor actions, necessary knowledge and the required skills. Thus, new requirements for the activities of teaching staff will be established in the description of the labor function in the professional standard instead of the previous Unified Qualification Handbook.

The main consequences of the introduction of professional standards

With the introduction of professional standards, only those employees who have studied in the relevant areas will be able to teach the relevant subjects and disciplines. However, it is not entirely clear what is meant by "direction". Some experts suggest that the direction should be understood as the exact correspondence of the direction of training and the discipline taught (a physicist will be able to teach only physics, but not computer science). Others point out that the direction is understood as an enlarged group in the understanding of the Order of the Ministry of Education and Science of September 12, 2013 N 1059 and the Order of the Ministry of Education and Science of September 12, 2013 N 1061. That is, a person who has received an education in the field of mathematics will be able to teach all disciplines corresponding to mathematical and natural sciences, namely mathematics, physics, computer science, etc. Since, in accordance with clause 4 of the Order of the Ministry of Education and Science of the Russian Federation (Ministry of Education and Science of Russia) dated September 12, 2013 N 1059, Moscow “On approval of the Procedure for the formation of lists of professions, specialties and areas of training” professions, specialties and areas of training related to one professional area, when forming lists, are combined into enlarged groups of professions, specialties and areas of training. It is highly controversial that teachers primary school will not be able to work as educators in preschool institutions and vice versa without additional retraining. Firstly, professional standards establish the same requirements for the education and training of the educator and teacher. Secondly, the differences between pedagogical activity on the implementation of pre-school education programs and the implementation of primary school education programs concerns only various labor functions and skill levels.

It should be noted that in accordance with the Order of the Ministry of Labor of August 5, 2016 No. 422n “On Amending the Professional Standard “Teacher”, changes were made to the requirements for education and training. Now for the teacher higher education or secondary vocational education within the enlarged groups of areas of training of higher education and specialties of secondary vocational education "Education and Pedagogical Sciences" or in the field corresponding to the subject taught, or higher education or secondary vocational education and additional vocational education in the field of activity in educational organization. Thus, the requirements were brought into line with the Uniform qualification handbook. Thus, the widespread opinion that a teacher is required to have an education or retraining in the field of pedagogical sciences does not correspond latest version professional standard requirements.

A significant part of the activity, which was previously fixed in the Provisions on Incentives and additionally encouraged, is now a mandatory labor function of a teacher and must be paid from the salary. So, now the teacher is obliged to possess such competencies as working with gifted children, deviant children, those for whom Russian is not their native language, as well as competencies in the field of inclusive education. The teacher should be able to interact with other specialists: psychologists, defectologists, social workers, and also have ICT skills.

What local regulations will be amended in the process of introducing professional standards?

Regulations on certification (in connection with the entry into force of the Federal Law "On independent assessment of qualifications" and the need to conduct certification in accordance with the requirements of professional standards);

Regulations on training (in connection with the change in the labor functions of a teacher);

Regulations on bonuses (on incentives) (in connection with the change in the labor functions of a teacher and the appearance among his mandatory functions of those for which incentive payments were previously supposed);

Regulations on structural divisions;

Staffing (in connection with the requirements for the qualifications of subject teachers, teachers elementary school, Russian language, mathematics);

Job descriptions (due to changes in job functions);

Employment contracts (due to changes in job functions and remuneration).

Is it possible to fire an employee who does not meet professional standards?

The provisions of labor law do not allow you to dismiss an employee just like that. If he does not meet the professional standard for the position he occupies, then he should be offered (if any) another position.

Also, the employer can send the employee for professional retraining. In accordance with Art. 196 of the Labor Code of the Russian Federation, training of employees and additional professional education of employees are carried out by the employer on the terms and in the manner determined by collective agreement, agreements, employment contract. For employees undergoing training, the employer must create the necessary conditions for combining work with education, provide guarantees established by labor law and other normative legal acts containing labor law norms, a collective agreement, agreements, local normative acts, an employment contract. It should be noted that the Ministry of Education and Science of the Russian Federation, together with the Trade Union of Workers public education and Science of the Russian Federation issued a letter No. 08-415 dated March 23, 2015 “On the implementation of the right of pedagogical workers to additional vocational education”, which, in particular, states that “The employer is not entitled to oblige employees to carry out CPE at their own expense, including such conditions cannot be included in the relevant contracts.” However, this letter is not normative act and is not mandatory.

If an employee refuses to be transferred to another position or undergo retraining, then nothing can be done with the employee until January 2020. At the same time, with the end of the transition period, all employees in the positions of teaching staff must comply with the requirements of the professional standard. Thus, from January 2020, an employee can be sent for an independent assessment of qualifications in order to obtain a certificate of conformity (the Federal Law “On Independent Assessment of Qualifications” comes into force on January 01, 2017).

An independent assessment of qualifications, if carried out at the direction of the employer, is carried out at the expense of the employer by the center for assessing qualifications. The specific procedure for conducting the assessment is approved by Decree of the Government of the Russian Federation dated November 16, 2016 N 1204 “On Approval of the Rules for Conducting an Independent Qualification Assessment Center in the Form of a Professional Examination”. Within thirty days, the applicant is issued a certificate of qualification (in case of successful passing the exam) or a conclusion on passing the qualification exam (in case of unsuccessful passing of the exam). AT this moment certificates of qualification are of an indefinite nature.

Thus, if an employee received a certificate of compliance based on the results of an independent qualification assessment, then he cannot be dismissed from the organization on the basis of non-compliance with professional standards. At the same time, the concepts of “certification for compliance with the position held” and “certification for compliance with the professional standard” should not be confused. In the event that the teacher does not pass an independent qualification assessment, then he may be dismissed under Art. 81 part 3 "due to insufficient qualifications, confirmed by the results of certification."

In the process of developing the document, the working group encountered great difficulties, which made it necessary to postpone the publication of the teacher's professional standard for 2 years. What should a modern teacher become in order to meet the new professional standard? Will teachers be able to adapt to the new rules of work? Testing the professional standard showed that the transition to new conditions is not always painless, but the result is worth it. From now on, a specialist in the field of education will have to attribute such mandatory qualities as:

  • maximum awareness (competence),
  • erudition,
  • progressiveness (creativity),
  • flexible approach
  • irreproachable appearance etc.

Without exception, all teachers - both young and already experienced - understand the importance and timeliness of the transition of the educational sphere to a new qualitative level. Development information technologies, new scientific challenges and learning opportunities - this requires continuous improvement educational processes. At the same time, against the background of his progressiveness, the teacher must remain a model of intelligence, sensitivity, kindness and real empathy for the success of his wards.

However, testing revealed serious problems: teachers complain about the lack of favorable conditions for fulfilling the requirements of the new professional standard. We are talking about greatly increased workloads, while already today many of them have to work for 1.5-2 rates. According to them, this will interfere with giving due attention to each student, realizing the requirement individual approach.
