In accordance with Article 8 of the Federal Law "On Narcotic Drugs and Psychotropic Substances", the Government of the Russian Federation decides:
1. Approve the attached Rules for admission of persons to work with narcotic drugs and psychotropic substances.
2. Federal executive authorities, if necessary, develop and, in agreement with the Ministry of Internal Affairs of the Russian Federation, approve regulatory legal acts based on the Rules for the admission of persons to work with narcotic drugs and psychotropic substances, approved by this resolution.

1. These Rules, developed in accordance with the Federal Law "On Narcotic Drugs and Psychotropic Substances", determine the procedure for admission to work with narcotic drugs and psychotropic substances of persons who, by virtue of their official duties, will have direct access to narcotic drugs and psychotropic substances.
2. The admission of persons to work with narcotic drugs and psychotropic substances is carried out by the heads of organizations, institutions and enterprises, regardless of their organizational and legal form (hereinafter referred to as organizations) or persons replacing them.
3. The admission of persons to work with narcotic drugs and psychotropic substances provides for familiarization of these persons with the legislation of the Russian Federation on narcotic drugs and psychotropic substances, as well as the inclusion in the employment contract (contract) of mutual obligations of the administration of the organization and the person associated with the circulation of narcotic drugs and psychotropic substances. substances.
4. The following persons are not allowed to work with narcotic drugs and psychotropic substances:
under 18 years of age;
having an outstanding or unexpunged conviction for a medium-gravity crime, a grave crime, an especially grave crime, or a crime related to the illegal circulation of narcotic drugs and psychotropic substances, including those committed outside the Russian Federation;
who have been charged with committing crimes related to illicit trafficking in narcotic drugs and psychotropic substances;
patients with drug addiction, substance abuse and chronic alcoholism;
recognized in accordance with the established procedure as unfit for work related to the circulation of narcotic drugs and psychotropic substances.
5. The preparation of materials for persons registered for work with narcotic drugs and psychotropic substances is carried out by personnel departments (departments), and in their absence - by an employee conducting personnel work in the organization.
6. In order to obtain the information specified in paragraph 4 of these Rules, the head of the organization or the person replacing him sends relevant requests to the internal affairs bodies at the location of this organization with the application of the questionnaire of the person registered for work with narcotic drugs and psychotropic substances, and to the health care institution at the place of residence of this person. Requests to the internal affairs bodies can be sent by the general list.
It is not allowed to send citizens to internal affairs bodies and healthcare institutions for the required documents.
7. Based on the data received from the internal affairs bodies and healthcare institutions by the personnel department (department), and in their absence, by the employee conducting personnel work in the organization, a written conclusion is drawn up on the possibility of admitting a person to work with narcotic drugs and psychotropic substances, which approved by the head of the organization or a person replacing him.
Prior to the approval of this document, the signing of an employment agreement (contract) is not allowed.
8. A citizen has the right to appeal, in accordance with the established procedure, against a refusal to allow him to work with narcotic drugs and psychotropic substances.
9. An employment contract (contract) with a person admitted to work with narcotic drugs and psychotropic substances may be terminated in cases established by the legislation of the Russian Federation, as well as upon clarification of the circumstances provided for in paragraph 4 of these Rules.
10. Students of educational institutions of higher and secondary vocational education are allowed to work with narcotic drugs and psychotropic substances during the educational process only in the presence of persons authorized to work with them in the prescribed manner.
11. Persons guilty of violating these Rules are liable in accordance with the legislation of the Russian Federation.

DRUGS AND PSYCHOTROPIC SUBSTANCES
1. These Rules determine the procedure for admission of persons to work with narcotic drugs and psychotropic substances, as well as to activities related to the circulation of precursors of narcotic drugs and psychotropic substances included in List I and Table I of List IV of the list of narcotic drugs, psychotropic substances and their precursors subject to control in the Russian Federation, approved by Decree of the Government of the Russian Federation of June 30, 1998 N 681 (hereinafter referred to as precursors).
2. The admission of persons to work with narcotic drugs and psychotropic substances is carried out by the heads of organizations, institutions and enterprises, regardless of their organizational and legal form (hereinafter referred to as organizations) or persons replacing them, and to activities related to the circulation of precursors - also individual entrepreneurs.
3. The admission of persons to work with narcotic drugs and psychotropic substances, as well as to activities related to the circulation of precursors, provides for familiarization of these persons with the legislation of the Russian Federation on narcotic drugs, psychotropic substances, precursors and the inclusion in the employment contract of mutual obligations of the organization (individual entrepreneur ) and persons involved in the circulation of narcotic drugs, psychotropic substances and (or) precursors.

6. In order to obtain the certificates provided for in paragraph four of paragraph 3 of Article 10 and (or) paragraph two of paragraph 7 of Article 30 of the Federal Law "On Narcotic Drugs and Psychotropic Substances", the head of the organization (a person replacing him) or an individual entrepreneur issues to a person registered on work with narcotic drugs, psychotropic substances, as well as for the implementation of activities related to the circulation of precursors, referral to medical organizations for passing, in accordance with the established procedure, a preliminary (periodic) medical examination (examination) and a mandatory psychiatric examination.
In order to obtain the conclusions provided for in paragraph five of paragraph 3 of Article 10 and (or) paragraph three of paragraph 7 of Article 30 of the Federal Law "On Narcotic Drugs and Psychotropic Substances", the head of the organization (the person replacing him) or an individual entrepreneur sends to the internal affairs bodies of the Russian Federation a request with the application of the questionnaire of the specified person in the forms and in the manner established by the Ministry of Internal Affairs of the Russian Federation.
The direction of these persons to the bodies of internal affairs of the Russian Federation to obtain such conclusions is not allowed.
7. In the absence of grounds preventing the admission of a person to work with narcotic drugs, psychotropic substances, as well as to activities related to the circulation of precursors, the head of the organization (the person replacing him) or an individual entrepreneur issues an appropriate order and concludes an employment contract with the specified person.
The period of validity of a person's admission to work with narcotic drugs, psychotropic substances, as well as to activities related to the circulation of precursors, is limited by the term of the employment contract.
8. A citizen has the right to appeal, in accordance with the established procedure, against a refusal of admission to work with narcotic drugs and psychotropic substances, as well as to activities related to the circulation of precursors.
9. The admission of a person to work with narcotic drugs and psychotropic substances, as well as to activities related to the circulation of precursors, shall be terminated upon identification of paragraphs four and five of clause 3 of Article 10 and paragraphs two and three of clause 7 of Article 30 of the Federal Law "On Narcotic means and psychotropic substances" circumstances preventing the issuance of relevant certificates and conclusions.
10. Students of organizations engaged in educational activities in educational programs of secondary vocational education and higher education are allowed to work with narcotic drugs, psychotropic substances and (or) precursors during the educational process only in the presence of persons admitted to work with them in the prescribed manner.
11. Persons guilty of violating these Rules are liable in accordance with the legislation of the Russian Federation.
