approve the attached Rules for determining the zoosanitary status of pig farms, as well as organizations engaged in the slaughter of pigs, processing and storage of pig products.

Rules for determining the zoosanitary status of pig farms, as well as organizations that slaughter pigs, process and store pig products

I. General provisions

1. These Rules for determining the zoosanitary status (compartment) of pig farms, as well as organizations engaged in the slaughter of pigs, processing and storage of pig products (hereinafter referred to as the Rules), were issued in order to harmonize the legal acts of the Russian Federation with international standards, provided for by the Decree of the Government of the Russian Federation dated 09/29/2009 N 761 "On ensuring the harmonization of Russian sanitary and epidemiological requirements, veterinary and sanitary and phytosanitary measures with international standards" (Sobraniye zakonodatelstva Rossiyskoy Federatsii, 2009, N 40, art. 4698).

The system of compartments is used to ensure a favorable epizootic status of pig farms of various types and to prevent the spread of contagious animal diseases on the territory of the Russian Federation.

2. These Rules apply to individuals and legal entities engaged in keeping and breeding pigs, as well as slaughtering pigs, processing and storing pig products (hereinafter referred to as farms).

These Rules do not apply to:

  1. individuals and legal entities engaged in the processing of pig products, producing exclusively products of animal origin, subjected during manufacture to heat treatment in a mode that ensures its disinfection (+72 ° C in the thickness of the product with an exposure of at least 30 minutes);
  2. individuals and legal entities that store exclusively products of animal origin subjected to heat treatment in the course of manufacture in the above mode.

3. Determination of the zoosanitary status of holdings (hereinafter - compartmentalization) is carried out on the basis of an analysis of the risks associated with the spread of pathogens of infectious animal diseases, including diseases common to humans and animals, and human infectious diseases, for which pigs can serve as an active or passive carrier, and also toxins of biogenic origin, which can cause poisoning of pigs or people when eating pig products (hereinafter referred to as pathogenic factors), and characterizes the degree of protection of the compartment.

4. According to the results of compartmentalization, the farm belongs to the following compartments:

  1. Compartment I - farms unprotected from threats;
  2. Compartment II - farms of a low level of protection;
  3. Compartment III - farms of medium level of protection;
  4. Compartment IV - farms of a high level of protection.

The assignment of the farm to compartments II - IV is carried out based on the results of a visit to the farm, carried out at the request of the farm, drawn up according to the attached sample (Appendix N 1).

The holdings that have not submitted an application and until they are visited belong to compartment I.

5. After the completion of compartmentalization on the territory of a constituent entity of the Russian Federation, the decision to introduce restrictive measures (quarantine) provided for by Article 17 of the Law of the Russian Federation of 14.05.1993 N 4979-1 "On Veterinary Medicine" (Bulletin of the Congress of People's Deputies of the Russian Federation and the Supreme Council of the Russian Federation, 1993, N 24, item 857; Collected Legislation of the Russian Federation, 2002, N 1, item 2; 2004, N 27, item 2711; N 35, item 3607; 2005, N 19, item 1752; 2006, No. 1, article 10; No. 52, article 5498; 2007, No. 1, article 29; No. 30, article 3805; 2008, No. 24, article 2801; 2009, No. 1, article 17, article 21), are accepted taking into account the zoosanitary status of farms.

II. Preparation of the compartmentalization procedure and its implementation

6. After a decision is made to carry out compartmentalization on the territory of a constituent entity of the Russian Federation, within a period of not more than 10 working days, according to the attached sample (Appendix No. 2), a list of individuals and legal entities engaged in keeping and breeding pigs, as well as slaughtering pigs, processing and storage of pig products located on the territory of the relevant subject of the Russian Federation (hereinafter referred to as the List of Farms), which is sent to the Chief State Veterinary Inspector of the Russian Federation, to the Federal Service for Veterinary and Phytosanitary Surveillance and is published for review in public information and telecommunication networks (including the network " Internet").

7. The Federal Service for Veterinary and Phytosanitary Surveillance, within 7 working days from the date of receipt of the List of farms, forms a consolidated list of farms of the Russian Federation (hereinafter - the Consolidated List) and places it on its official website.

Changes, additions to the Consolidated List are made by the Federal Service for Veterinary and Phytosanitary Surveillance no later than 7 working days after receipt of information about the introduction of changes, additions to the List of farms.

8. The start of compartmentalization of the farms included in the List of farms is notified in writing no later than 1 working day before their visit.

9. All holdings included in the List of Holdings and the Consolidated List are assigned to Compartment I until a decision is made to assign them to compartments with a higher animal health status.

10. In accordance with Art. 9 of the Law of the Russian Federation of May 14, 1993 N 4979-1 "On Veterinary Medicine" (Bulletin of the Congress of People's Deputies and the Supreme Council of the Russian Federation, 1993, N 24, article 857; Collection of Legislation of the Russian Federation, 2002, N 1, article 2 ; 2004, N 27, item 2711; N 35, item 3607; 2005, N 19, item 1752; 2006, N 1, item 10; 2007, N 1, item 29; N 30, item 3805 ; 2009, N 1, article 17, article 21) farms are visited for the purpose of anti-epizootic and other veterinary measures.

Upon receipt of the application specified in paragraph 4 of these Rules, a visit to the farm is organized, provided for in this paragraph of the Rules.

A visit to the farm in order to classify the farm to compartment IV is carried out with the participation of the territorial body of the Rosselkhoznadzor for the corresponding subject of the Russian Federation.

11. Based on the results of the visit to the farm, a certificate is drawn up, which contains information on the compliance of the farm with the criteria for compartmentalization.

The certificate includes the following information about the farm:

  1. name (for an individual - last name, first name, patronymic);
  2. location address;
  3. types of activities carried out;
  4. the time of the visit provided for in paragraphs 4, 10 of these Rules;
  5. assessment of the compliance of the farm with the criteria for compartmentalization (for each criterion).

If the farm is recognized as meeting the criteria for compartment IV, the certificate is approved by the head of the territorial body of the Rosselkhoznadzor within 2 working days.

12. Information on the results of compartmentalization on the territory of a constituent entity of the Russian Federation is sent to the Chief State Veterinary Inspector of the Russian Federation and to the Federal Service for Veterinary and Phytosanitary Surveillance within a week after signing the certificate to amend the Consolidated List.

III. Compartmentalization Criteria

13. Compartmentalization of farms engaged in keeping and breeding pigs

13.1. Compartment I includes farms that are not assigned to other compartments or prior to their visit, provided for in paragraphs 4, 10 of these Rules.

13.2. Compartment II includes farms that meet the following criteria:

  1. a) pigs from compartment I are not introduced into holdings (including genetic material and temporary introduction of pigs for any purpose);
  2. b) farms are not technologically connected with compartment I (transport, personnel, packaging, veterinary specialists, etc.), except for the supply of pigs and pig genetic material from this farm to compartment I farms;
  3. c) walking of pigs outside the territory of farms is not carried out;
  4. d) the territory of the holdings is fenced in a way that prevents the penetration of wild animals (with the exception of birds and small rodents);
  5. e) there is no entry of unauthorized persons and entry of unauthorized vehicles into the territory of farms;
  6. f) farms do not use food waste for animal feed.

13.3. Compartment III includes holdings that meet the criteria listed in paragraph 13.2 of these Regulations, as well as the following criteria:

  1. a) pigs from compartment II are not introduced into holdings (including genetic material and temporary introduction of pigs for any purpose);
  2. b) farms are not technologically connected with compartment II (transport, personnel, packaging, veterinary specialists, etc.), except for the supply of pigs and pig genetic material from this farm to compartment II farms;
  3. c) the possibility of contact of farm workers with domestic and (or) wild pigs or visits by workers of farms belonging to compartments I and II is excluded;
  4. d) walking of pigs outside the livestock premises of farms is not carried out;
  5. e) there are no holdings belonging to compartments I and II within a radius of 500 meters;
  6. f) production buildings of farms are protected from the penetration of animals (including birds), atmospheric precipitation and groundwater;
  7. g) there is no visit to the production premises of farms by persons (including officials of bodies authorized to exercise state control (supervision) who have been in contact with domestic and (or) wild pigs during the previous 2 weeks (including visits to hunting farms, participation in the hunting of wild pigs ) who visited farms belonging to compartments I and II, epizootic foci, or participated in anti-epizootic measures;
  8. h) entrance to the production premises of farms is carried out with a complete change of clothes and shoes;
  9. i) only feed and feed additives subjected to sterilizing treatment, heat treatment (granulation) are used in feed for farm animals;
  10. j) farms keep records of incoming feed, indicating their manufacturer and preparation modes;
  11. k) in farms, all veterinary measures and procedures carried out with pigs are taken into account;
  12. l) among the livestock of farms there were no cases of the following infectious diseases of pigs:
    1. African swine fever within the last 3 years;
    2. classical swine fever within the last 12 months;
    3. vesicular disease within the last 12 months;
    4. transmissible gastroenteritis within the last 2 years;
    5. Teschen's disease within the last 12 months;
    6. Aujeszky's disease within the last 12 months;
    7. porcine respiratory reproductive syndrome within the last 2 years;
    8. parvovirus disease of pigs within the last 2 years.

13.4. Compartment IV includes holdings that meet the criteria listed in paragraph 13.3 of these Regulations, as well as the following criteria:

  1. a) pigs from compartments I, II and III (including genetic material and temporary introduction of pigs for any purpose) are not brought to the holdings for at least 12 months;
  2. b) for at least 12 months, the farms are not technologically connected with compartments I, II and III (transport, personnel, packaging, veterinary specialists, etc.), with the exception of the supply of pigs from this farm to the farms of compartments I, II and III and genetic material of pigs;
  3. c) the possibility of contact of workers of farms during the previous 12 months with domestic and (or) wild pigs or visits by workers of farms belonging to compartments I, II and III is excluded;
  4. d) farms do not walk pigs;
  5. e) there are no farms belonging to compartment III within a radius of 500 meters;
  6. f) there is no visit to the production premises of farms by persons (including veterinary specialists and officials of bodies authorized to exercise state control (supervision), who have been in contact with domestic and (or) wild pigs during the previous 2 weeks (including visits to hunting farms, participation in hunting for wild pigs) who visited farms belonging to compartment III, epizootic foci, or participated in anti-epizootic measures;
  7. g) the entrance to the production premises of farms for at least 12 previous months is carried out through a sanitary checkpoint with full sanding, change of clothes and shoes;
  8. h) work clothes on farms are washed daily directly in the clean production area of ​​the farm;
  9. i) the feed delivery vehicle is not used to deliver feed to holdings in compartments I, II and III;
  10. j) during the previous 2 years, there were no cases of salmonellosis, as well as hemophilic polyserositis and pleuropneumonia among the livestock of farms, and there were no cases of detection of respiratory coronavirus, as well as swine influenza virus (excluding infection of pigs with strains of human influenza A virus).

14. Compartmentalization of farms that slaughter pigs

14.1. Compartment I includes farms that are not assigned to other compartments or prior to their visit, provided for in paragraphs 5, 11 of these Rules.

14.2. Compartment II includes farms that slaughter pigs in accordance with the requirements of the legislation of the Russian Federation and meet the following criteria:

  1. a) slaughter of pigs grown in the farms specified in paragraph 13.1 of these Rules is not carried out;
  2. b) transport is not used for the transportation of pigs raised in the farms specified in paragraph 13.1 of these Rules;
14.3. Compartment III includes holdings that meet the criteria listed in paragraph 14.2 of these Regulations, as well as the following criteria:
  1. a) slaughter of pigs grown in the farms specified in paragraph 13.2 of these Rules is not carried out;
  2. b) transport is not used for the transportation of pigs raised in the farms specified in paragraph 13.2 of these Rules.
  3. g) there is no entry of unauthorized persons and entry of unauthorized vehicles into the territory of farms;
  4. h) visits to production facilities where pigs are kept are not carried out by persons (including veterinary specialists and officials of bodies authorized to exercise state control (supervision) who have been in contact with domestic and (or) wild pigs during the previous 2 weeks (including visiting hunting farms, participation in the hunting of wild pigs), who visited farms belonging to compartments I and II, epizootic foci, or participated in anti-epizootic measures.

14.4. Compartment IV includes holdings that meet the criteria listed in paragraph 14.3 of these Regulations, as well as the following criteria:

  1. a) for at least 12 months, no slaughter of pigs grown in the farms specified in paragraphs 13.1, 13.2, 13.3 of these Rules is carried out;
  2. b) transport for at least 12 months is not used for the transportation of pigs raised in the farms specified in paragraphs 13.1, 13.2, 13.3 of these Rules;
  3. c) farms are not connected with compartments I, II technologically (transport, personnel, packaging, veterinary specialists, etc.);
  4. d) within a radius of 500 meters there are no farms specified in paragraphs 13.3 of these Rules;
  5. e) no restrictive measures (quarantine) have been introduced on farms for at least 12 previous months;
  6. f) no visits are made to production facilities where pigs are kept by persons (including veterinary specialists and officials of bodies authorized to exercise state control (supervision)), who have been in contact with domestic and (or) wild pigs (including visits to hunting farms, participation in the hunting of wild pigs), who visited farms belonging to compartment III, epizootic foci or participated in anti-epizootic measures;
  7. g) the farm operates under the supervision of a veterinary inspector.

15. Compartmentalization of farms processing pig products

15.1. Compartment I includes farms that are not assigned to other compartments or prior to their visit, provided for in paragraphs 4, 10 of these Rules.

15.2. Compartment II includes farms that process pig products in accordance with the requirements of the legislation of the Russian Federation and meet the following criteria:

  1. a) the farms do not process pig products obtained from pigs raised on the farms specified in paragraph 13.1 of these Rules, or slaughtered on the farms specified in paragraph 14.1 of these Rules;
  2. b) transport is not used for the transportation of pig products obtained from pigs obtained in the farms specified in paragraph 14.1 of these Rules.

15.3. Compartment III includes holdings that meet the criteria listed in paragraph 15.2 of these Regulations, as well as the following criteria:

  1. a) the farms do not process pig products obtained from pigs raised on the farms specified in clause 13.2 of these Rules, or slaughtered on the farms specified in clause 14.2 of these Rules;
  2. b) transport is not used for the transportation of pig products obtained from pigs obtained in the farms specified in paragraph 14.2 of these Rules;
  3. c) farms are not connected with compartments I, II technologically (transport, personnel, packaging, veterinary specialists, etc.);
  4. d) the possibility of contact of farm workers with domestic and (or) wild pigs or visits by workers of farms belonging to compartments I, II is excluded;
  5. e) the territory of the holdings is fenced in a way that excludes the penetration of wild animals;
  6. f) within a radius of 500 meters there are no farms specified in paragraphs 13.1, 13.2 of these Rules;
  7. g) there is no entry of unauthorized persons and entry of unauthorized vehicles into the territory of farms.

15.4. Compartment IV includes holdings that meet the criteria listed in paragraph 15.3 of these Regulations, as well as the following criteria:

  1. a) the farms do not process pig products obtained from pigs raised on the farms specified in clause 13.3 of these Rules, or slaughtered on the farms specified in clause 14.3 of these Rules;
  2. b) transport is not used for the transportation of pig products obtained from pigs obtained in the farms specified in paragraph 14.3 of these Rules;
  3. c) farms are not connected with compartments III technologically (transport, personnel, packaging, veterinary specialists, etc.);
  4. e) the territory of the holdings is fenced in a way that excludes the penetration of wild animals;
  5. f) within a radius of 500 meters there are no farms specified in paragraph 13.3 of these Rules;
  6. g) no restrictive measures (quarantine) have been introduced on farms for at least 12 previous months;
  7. h) the farm operates under the supervision of a veterinary inspector.

16. Compartmentalization of farms storing pig products

16.1. Compartment I includes farms that are not assigned to other compartments or prior to their visit, provided for in paragraphs 4, 10 of these Rules.

16.2. Compartment II includes farms that store pig products in accordance with the requirements of the legislation of the Russian Federation and meet the following criteria:

  1. a) the farms do not store pig products obtained from pigs raised on the farms specified in clause 13.1 of these Rules, killed on the farms specified in clause 14.1 of these Rules, or processed on the farms specified in clause 15.1 of these Rules;
  2. b) the transport is not used for the transportation of pig products obtained from pigs raised on the farms specified in paragraph 13.1 of these Rules, slaughtered on the farms specified in paragraph 14.1 of these Rules, or processed on the farms specified in paragraph 15.1 of these Rules.

16.3. Compartment III includes holdings that meet the criteria listed in paragraph 16.2 of these Regulations, as well as the following criteria:

  1. a) the farms do not store pig products obtained from pigs raised on the farms specified in clause 13.2 of these Rules, slaughtered on the farms specified in clause 14.2 of these Rules, or processed on the farms specified in clause 15.2 of these Rules;
  2. b) transport is not used for the transportation of pig products obtained from pigs raised on the farms specified in paragraph 13.2 of these Rules, slaughtered on the farms specified in paragraph 14.2 of these Rules, or processed on the farms specified in paragraph 15.2 of these Rules.

16.4. Compartment IV includes holdings that meet the criteria listed in paragraph 16.3 of these Regulations, as well as the following criteria:

  1. a) the farms do not store pig products obtained from pigs raised on the farms specified in clause 13.3 of these Rules, slaughtered on the farms specified in clause 14.3 of these Rules, or processed on the farms specified in clause 15.3 of these Rules;
  2. b) the transport is not used for the transportation of pig products obtained from pigs raised on the farms specified in paragraph 13.3 of these Rules, slaughtered on the farms specified in paragraph 14.3 of these Rules, or processed on the farms specified in paragraph 15.3 of these Rules;
  3. c) the farm operates under the supervision of a veterinary inspector.

IV. Final provisions

17. Appeal against actions (inaction) and decisions of officials carried out (adopted) during compartmentalization is carried out in accordance with the legislation of the Russian Federation.

18. If during the visit a non-compliance of the farm with at least one of the criteria for compartmentalization is revealed, the zoosanitary status assigned to the farm is reduced. The relevant information is recorded in the certificate and entered into the List of farms, the Consolidated List.

19. A holding may apply to be assigned to a compartment with a higher animal health status. Consideration of this application is carried out in the same manner as the application specified in paragraph 4 of these Rules.

VETERINARY RULES
determination of the zoosanitary status for poultry facilities, enterprises (complexes), as well as organizations that slaughter poultry, receive (collect), process and store poultry products

I. General provisions

1. These Rules for determining the zoosanitary status (compartment) of facilities where activities are carried out for the maintenance and breeding of poultry, as well as wild birds in semi-free conditions or artificially created habitats, their slaughter, processing, and storage of controlled goods of animal origin obtained from birds, their sale (hereinafter referred to as the objects, hereinafter referred to as the Rules), were issued in order to harmonize the legal acts of the Russian Federation with international standards provided for by Decree of the Government of the Russian Federation of September 29, 2009 N 761 "On ensuring the harmonization of Russian sanitary and epidemiological requirements, veterinary and sanitary and phytosanitary measures with international standards" (Sobraniye zakonodatelstva Rossiyskoy Federatsii, 2009, N 40, item 4698).

2. In these rules, poultry means:

domesticated representatives of the Aves class, which are kept in semi-free conditions or in an artificially created habitat in order to obtain products from them, namely eggs, meat, meat and other products of slaughter (hunting), feathers and down (hereinafter referred to as poultry), as well as embryos (hatching eggs) intended for breeding chicks intended for obtaining the specified products, belonging to the following systematic groups:

order of galliformes (Galliformes), species - chicken (Gallus gallus domesticus), turkey (Meleagris gallopavo), guinea fowl (Numida meleagris), pheasant (Phasianus colchicus), Japanese quail (Coturnix japonica);

order of anseriformes (Anseriformes), species gray goose (synonym (hereinafter - synonym): common goose) (Anser anser), swan (Anser cygnoides), duck (Anas platyrhynchos f. domestica, syn: Anas platyrhynchos domesticus, Anas domesticus, Anas domestica, Anas boschas domestica), Muscovy duck (Cairina moschata), mute swan (Cygnus olor);

detachment of ostriches (Struthioniformes), species African black ostrich (Struthio camelus);

3. For the purposes of these rules, domesticated birds are domesticated members of the Aves class kept in semi-free conditions or artificially created habitats for the purpose of their use in sporting events, other official purposes, including postal communication (hereinafter referred to as service birds), as well as to obtain offspring intended for the same purposes, belonging to the following systematic groups:

order of pigeon-like (Columbiformes), species - common dove (syn. gray dove) (Columba livia var. domestica), fighting chickens (Gallus gallus domesticus).

3.1. Birds of prey, kept in semi-free conditions or artificially created habitat, used for hunting and protection of objects from birds and rodents, namely:

falcon (all species of the genus Falco);

hawks (all species of the subfamilies Accipitrinae, Polyboroidinae and Melieraxinae);

kites (all species of the subfamilies Milvinae, Perninae and Elaninae);

eagles (all species of the subfamilies Aquilinae and Haliaeetinae);

buzzards (all species of subfamilies Buteoninae);

owls (all species of the Strigidae family);

3.2. In cases where these birds are bred in captivity or removed (by any means - nests, fledglings, wild flies) from the wild for further keeping for the specified purposes.

3.4. Domesticated representatives of the Aves class, which are kept in semi-free conditions or artificially created habitats for aesthetic purposes, as well as as companion animals, including indoor, songbirds, ornamental birds (hereinafter referred to as companion birds), as well as for obtaining offspring intended for the same goals related to the following systematic groups:

order of passeriformes (Passeriformes), species - canary (Serinus canaria domestica);

order of parrots (Psittaciformes), all species, family of finches (Estrildidae) species Zebra finches (Taeniopygia guttata),

4. The assignment of objects to one of the compartments (hereinafter - compartmentalization) is used to ensure a favorable epizootic status of poultry facilities, prevent the spread of contagious animal diseases in the territory of the Russian Federation, reduce, without prejudice to biological safety, restrictions on the movement of regulated goods in cases of infectious animal diseases. .

5. These Rules apply to individuals and legal entities that own or have economic introduction or operational management, facilities where activities are carried out for keeping and breeding poultry, as well as slaughtering poultry, processing and storing poultry products. The object must have an actual address (location) and meet the criteria established in Section III of these Rules

6. Compartmentalization is not subject to objects that carry out:

processing of products from birds and, as a result, producing exclusively products of animal origin obtained from birds or including components obtained from birds (hereinafter referred to as products from birds), subjected to heat treatment during manufacture in modes that ensure its disinfection (+72 ° C in thicker than the product when exposed for at least 30 minutes or more effective);

storage of exclusively products from birds, subjected to heat treatment in the course of manufacture in the above modes;

sale of exclusively products from birds, subjected to heat treatment in the course of manufacture in the above modes,

7. Compartmentalization is carried out on the basis of an analysis of the risks associated with the spread of pathogens of infectious diseases of birds, including diseases common to humans and birds, and human infectious diseases, for which birds can serve as an active or passive vector, and on the use of technological and / or engineering methods for managing these risks, which characterizes the degree of protection of the compartment.

8. Based on the results of compartmentalization, the object belongs to the following compartments:

Compartment I - objects unprotected from threats;

Compartment II - objects of low level of protection;

Compartment III - objects of an average level of protection;

Compartment IV - objects of a high level of protection.

The assignment of an object to compartments II - IV is carried out based on the results of a visit to the object, carried out upon the application of the object (hereinafter referred to as the Survey), drawn up according to the attached sample (Appendix to these Rules) (hereinafter referred to as the Application).

9. Subjects that have not submitted Applications, and until their Survey is conducted, belong to Compartment I.

10. After the completion of the compartmentalization on the territory of the constituent entity of the Russian Federation, the decision to introduce restrictive measures (quarantine) provided for in Article 17 of the Law of the Russian Federation of May 14, 1993 N 4979-1 "On Veterinary Medicine" (Bulletin of the Congress of People's Deputies of the Russian Federation and the Supreme Council of the Russian Federation, 1993, N 24, item 857; Collected Legislation of the Russian Federation, 2002, N 1, item 2; 2004, N 27, item 2711; N 35, item 3607; 2005, N 19, item 1752; 2006, No. 1, article 10; No. 52, article 5498; 2007, No. 1, article 29; No. 30, article 3805; 2008, No. 24, article 2801; 2009, No. 1, article 17, article 21), (hereinafter referred to as the Law "On Veterinary Medicine") are adopted taking into account the zoosanitary status of objects.

II. Preparation of the compartmentalization procedure and its implementation

11. After a decision is made to carry out compartmentalization on the territory of a constituent entity of the Russian Federation, within a period of no more than 10 working days, a list of objects located on the territory of the corresponding constituent entity of the Russian Federation (hereinafter - the List of objects) is formed in the Federal State Information System in the field of veterinary medicine (hereinafter - FSIS) .

12. The Federal Service for Veterinary and Phytosanitary Surveillance (hereinafter referred to as Rosselkhoznadzor), within 10 working days from the date of receipt of certificates of objects (hereinafter referred to as the Certificate) from the FSIS, that fully comply with the requirements of these Rules, coordinates the Certificates.

13. About the upcoming Inspection of the object, included in the List of objects and submitted the Application, are notified in writing no later than one working day before their Inspection.

14. All objects included in the List of objects belong to compartment I until a decision is made on their assignment to compartments with a higher animal health status.

15. In accordance with Article 9 of the Law "On Veterinary Medicine", objects are visited in order to verify their compliance with the legislation of the Russian Federation in the field of veterinary medicine, and to carry out anti-epizootic and other veterinary measures.

15.1. Upon receipt of the Application, the executive authority in the field of veterinary medicine of the constituent entity of the Russian Federation organizes the Examination.

15.2. A survey with the aim of classifying an object to compartments III and IV is carried out with the participation of the territorial body of the Rosselkhoznadzor for the corresponding subject of the Russian Federation.

16. Based on the results of the Survey, a Certificate is drawn up, which contains information on the compliance of the object with the criteria for compartmentalization.

17. The Help includes the following information about the object:

name (for an individual - last name, first name, patronymic);

location address;

types of activities carried out;

time of the Survey;

certificate validity period

assessment of the compliance of the object with the criteria of compartmentalization (for each criterion).

18. If the object is recognized as complying with the criteria for classifying to compartments III or IV, the Certificate is agreed within two working days by the head or deputy head of the territorial body of the Rosselkhoznadzor in charge of veterinary issues.

19. A certificate of compliance of the object with the criteria for compartmentalization is placed in the FSIS.

20. If the object is recognized as meeting the criteria for compartments III and IV, the Certificate, before being placed in the FSIS, is agreed within 2 working days by the head or deputy head of the territorial body of the Rosselkhoznadzor in charge of veterinary issues.

21. If in the Certificate the information on the compliance of the object with the criteria is not set out in full in accordance with paragraph 17, or does not meet other criteria of these Rules, the Rosselkhoznadzor returns the Certificate for revision, indicating the reasons, and excludes it from the FSIS.

22. Information about the FSIS based on the results of the compartmentalization of objects on the territory of a constituent entity of the Russian Federation is posted by Rosselkhoznadzor on its official website in the Internet information and telecommunication network.

III. Compartmentalization Criteria

23. Criteria for compartmentalization of facilities engaged in keeping and breeding birds, including for the purpose of obtaining food and hatching eggs, down and feathers.

23.1. Compartment I includes objects before their Survey, or which are not assigned to other compartments.

23.2. Compartment II includes facilities that keep and breed birds in accordance with the requirements of the legislation of the Russian Federation and meet the following criteria:

a) birds, hatching eggs, and genetic material from compartment I are not imported and within 3 months prior to the Survey were not imported to the facilities;

b) the object is not technologically connected with compartment I (transport, personnel, packaging, veterinary specialists, etc.), except for the supply of birds, their genetic material and hatching eggs from this object to compartment I objects;

d) the territory of the object is fenced in a way that prevents the penetration of wild animals, with the exception of birds and small rodents;

e) there is no entry of unauthorized persons and entry of unauthorized vehicles into the territory of the facility;

f) the facility does not use food waste for poultry feed.

23.3. Compartment III includes facilities that keep and breed birds in accordance with the requirements of the legislation of the Russian Federation that meet the criteria listed in clause 23.2 of these Rules, as well as the following criteria:

a) is not kept at the facility and was not kept at the facility for at least 3 months prior to the Survey, is not imported to the facility and for at least 3 months prior to the Survey was not imported any animals except birds;

b) birds, their hatching eggs and genetic material from the objects assigned to compartments I and II were not imported to the site, and within 3 months prior to the Survey were not imported;

c) the object is not connected and within 3 months has not been connected with the objects where birds are kept, their slaughter is carried out, and which are technologically assigned to compartments I and II (transport, personnel, containers, veterinary specialists, etc.), except for the supply from this facility to facilities assigned to compartments I and II, birds, their hatching eggs, table eggs, as well as genetic material;

d) employees are not allowed to visit facilities where birds are kept, and which are assigned to compartments I and II, the possibility of contact of facility workers with birds kept in other facilities is excluded,

e) there is no visit to the production premises of the facility by persons (including officials of bodies authorized to exercise state control (supervision)), who have been in contact with domestic and (or) wild birds during the previous two weeks (including visits to hunting farms, participation in the hunting of wild birds ) who visited objects belonging to compartments I and II, epizootic foci, or participated in anti-epizootic measures against birds of any species;

f) bird walking is not carried out;

g) within a radius of 500 meters there are no facilities for keeping birds belonging to compartments I and II;

h) the production facilities of the facility are protected from the penetration of animals (including birds and rodents), precipitation and groundwater;

i) the entrance to the territory of the facility is carried out:

m) monitoring is carried out at the facility in order to detect latent circulation of Newcastle disease viruses, avian bronchitis, avian laryngotracheitis, Gumboro disease, pathogens of salmonellosis, psittacosis and pullorosis,

or the following contagious bird diseases have not occurred at the facility for one year:

newcastle disease,

highly pathogenic avian influenza,

bird bronchitis,

ornithosis,

mycoplasmosis (Mycoplasma gallisepticum),

or after the occurrence of these diseases, the entire population of birds was completely slaughtered, cleaned, disinfected, and within 21 days (three months in case of highly pathogenic avian influenza) and after the repopulation of the object, there were no infectious diseases listed above and the latent circulation of their pathogens,

o) each technological group of birds kept at one production site is assigned a separate staff of veterinary specialists and poultry care personnel;

p) the territory of the object is fenced in a way that prevents the penetration of wild animals, with the exception of birds and small rodents;

c) there is no entry of unauthorized persons and entry of unauthorized vehicles into the territory of the facility;

r) the facility does not use food waste for poultry feed.

23.3.1. Compartment III includes objects that have had the status of compartment III for no more than 3 years from the date of the last examination for compliance with compartment III, or confirmed the status of compartment III before the expiration of the period.

23.4. Compartment IV includes facilities that keep and breed birds in accordance with the requirements of the legislation of the Russian Federation that meet the criteria listed in clause 23.3 of these Rules, as well as the following criteria:

a) birds, their hatching eggs, as well as genetic material from the objects assigned to compartments I, II and III are not imported to the site, and within six months prior to the Survey were not imported;

b) the object is not connected and within six months has not been connected with the objects where birds are kept, their slaughter is carried out, and which are assigned to compartments I, II and III, technologically (transport, personnel, containers, veterinary specialists, etc. ), with the exception of the supply from this facility to facilities assigned to compartments I, II and III, of birds, their hatching eggs, eggs of food, as well as genetic material;

c) workers are not allowed to visit facilities where birds are kept, and which are assigned to compartments I, II and III, the possibility of contact of facility workers with birds kept at other facilities is excluded;

d) there is no visit to the production premises of the facility by persons (including officials of bodies authorized to exercise state control (supervision) who have been in contact with domestic and (or) wild birds during the previous two weeks (including visits to hunting farms, participation in hunting for wild birds ) who visited objects belonging to compartments I, II and III, epizootic foci, or participated in anti-epizootic measures against birds of any species;

e) bird walking is not carried out;

e) there are no facilities for keeping birds belonging to compartments I, II and III within a radius of one kilometer;

g) the production facilities of the facility are protected from the penetration of animals (including birds and rodents), precipitation and groundwater;

h) entrance to the territory of the facility is carried out:

with sanitary and shower treatment and with a complete change of clothes and shoes, and in the production premises of the object - with a complete change of clothes and shoes, or with a complete change of clothes and shoes, and in the production premises of the object - with sanitary and shower treatment and with a complete change of clothes and shoes;

i) work clothes at the facility are subjected to daily processing and / or washing in a clean production area of ​​the facility;

j) only compound feeds, feed additives (premixes) of industrial production that have undergone disinfectant heat or other treatment during manufacture are used in poultry feed;

k) at the facility, the incoming feed is accounted for, indicating the date, place of manufacture / procurement and the name of the manufacturer and cooking modes;

l) at the facility, all veterinary measures and procedures carried out with birds are taken into account;

m) monitoring is carried out at the facility to detect latent circulation of Newcastle disease viruses, highly pathogenic influenza, avian bronchitis, avian laryngotracheitis, Gumboro disease, pathogens of mycoplasmosis (Mycoplasma gallisepticum), salmonellosis, psittacosis and pullorosis;

and either the following contagious bird diseases have not occurred at the facility for one year:

newcastle disease,

highly pathogenic avian influenza,

bird bronchitis,

avian laryngotracheitis,

Gumboro Disease,

ornithosis,

mycoplasmosis (Mycoplasma gallisepticum),

or after the occurrence of these diseases, the entire population of birds was completely slaughtered, cleaned, disinfected, and within 21 days (three months in case of highly pathogenic influenza) and after the repopulation of the object, there were no infectious diseases listed above and the latent circulation of their pathogens;

n) the possibility of bringing food products and other items and materials that pose an epizootic / epidemic risk to the territory of the enterprise is excluded by the personnel working at the facility;

o) for each technological group of birds kept at one production site, a staff of veterinary specialists and bird care personnel is assigned;

p) a feed delivery vehicle is not used to deliver feed to a facility belonging to compartments I, II and III;

c) the territory of the facility is fenced in a way that prevents the penetration of wild animals, with the exception of birds and small rodents;

r) there is no entry of unauthorized persons and entry of unauthorized vehicles into the territory of the facility;

s) the facility does not use food waste for bird feed.

23.4.1. Compartment IV includes objects that have had compartment IV status for no more than three years from the date of the last examination for compliance with compartment IV, or confirmed the status of compartment IV before the expiration of the period.

IV. Compartmentalization of bird slaughter facilities

24.1. Compartment I includes objects that are not assigned to other compartments or prior to their Survey.

24.2. Compartment II includes facilities that slaughter birds in accordance with the requirements of the legislation of the Russian Federation and meet the following criteria:

a) the facility does not slaughter birds raised in facilities classified as Compartment I;

b) transport is not used for the transport of birds reared in facilities assigned to compartment I.

24.3. Compartment III includes facilities that slaughter birds in accordance with the requirements of the legislation of the Russian Federation that meet the criteria listed in clause 15.2 of these Rules, as well as the following criteria:

a) there is no slaughter of birds reared in facilities assigned to compartments I and II;

b) transport is not used for the transport of birds reared in facilities assigned to compartments I and II;.

c) objects are not technologically connected with compartments I and II (transport, personnel, packaging, veterinary specialists, etc.), excluding the transfer of slaughter products to enterprises assigned to compartments I and II;

d) the possibility of contact of employees of the facility with domestic and (or) wild birds or visits by employees of facilities belonging to compartments I and II is excluded;

f) within a radius of 500 meters there are no facilities where birds are kept;

g) there is no entry of unauthorized persons and entry of unauthorized vehicles into the territory of the facilities;

h) there are no visits to production premises where birds are kept by persons (including specialists in the field of veterinary medicine and officials of bodies authorized to exercise state control (supervision) who have been in contact with domestic and (or) wild birds during the previous 2 weeks (including visiting hunting grounds, participation in hunting), visiting objects belonging to compartments I and II, epizootic foci, or participating in anti-epizootic measures against bird diseases.

24.3.1. Compartment III includes objects that have had Compartment III status for no more than three years from the date of the last examination for compliance with Compartment III, or confirmed the status of Compartment III before the expiration of the period.

24.4. Compartment IV includes facilities that slaughter birds in accordance with the requirements of the legislation of the Russian Federation that meet the criteria listed in paragraph 24.3 of these Rules, as well as the following criteria:

a) for at least 12 months, no slaughter of birds reared in facilities assigned to compartments I-III is carried out;

b) transport for at least 12 months is not used for the transport of birds reared in facilities assigned to compartments I-III;

c) objects are not technologically connected with compartments I-III (transport, personnel, packaging, veterinary specialists, etc.), except for the transfer of slaughter products to enterprises assigned to compartments I-III;

d) the possibility of contact of employees of facilities with domestic and (or) wild birds or visits by employees of facilities belonging to compartments I, II is excluded;

e) the territory of the objects is fenced in a way that excludes the penetration of wild animals;

f) within a radius of 500 meters there are no facilities where birds are kept and slaughtered, assigned to compartments I-III;

g) restrictive measures (quarantine) have not been introduced at the facilities for at least one year;

h) there is no entry of unauthorized persons and entry of unauthorized vehicles into the territory of the facilities;

i) visits to production premises where birds are kept are not carried out by persons (including specialists in the field of veterinary medicine and officials of bodies authorized to exercise state control (supervision)), who have been in contact with domestic and (or) wild birds (including visits to hunting farms, participation in hunting), who visited objects belonging to compartments I-III, epizootic foci or participated in anti-epizootic measures against birds.

24.4.1. Compartment IV includes objects that have had compartment IV status for no more than three years from the date of the last examination for compliance with compartment IV, or confirmed the status of compartment IV before the expiration of the period.

V. Compartmentalization of facilities processing poultry products

25.1. Compartment I includes objects that are not assigned to other compartments or prior to the Survey.

25.2. Compartment II includes facilities that process poultry products in accordance with the requirements of the legislation of the Russian Federation and meet the following criteria:

a) the facility does not import or process products derived from birds, reared from Compartment I and/or slaughtered from Compartment I facilities;

products from birds stored in facilities assigned to compartment I;

products from birds kept and/or killed in facilities assigned to compartment I,

products from birds manufactured in facilities assigned to compartment I,

bird products stored in facilities assigned to compartment I;

e) the object is not technologically connected with compartment I (transport, personnel, packaging, veterinary specialists, etc.), excluding the export of poultry products to enterprises assigned to compartments I.;

f) the territory of the object is fenced in a way that excludes the penetration of wild animals.

25.3. Compartment III includes facilities that process poultry products in accordance with the requirements of the legislation of the Russian Federation that meet the criteria listed in paragraph 23.2 of these Rules, as well as the following criteria:

a) the facility does not import or process products derived from birds raised in facilities assigned to Compartments I and II, or slaughtered in facilities assigned to Compartments I and II;

b) the vehicle is not used for the transport of birds;

c) transport that exports processed products is washed and disinfected before entering the facility or is not used for transportation:

d) the transport that imports raw materials is washed and disinfected before loading the delivered raw materials or is not used for transportation:

products from birds kept and/or killed in facilities assigned to compartments I and II,

products from birds manufactured at facilities assigned to compartments I and II,

bird products stored in facilities assigned to compartments I and II.

e) the object is not technologically connected with compartments I, II (transport, personnel, packaging, veterinary specialists, etc.), excluding the export of processed products to enterprises assigned to compartments I and II;

f) the possibility of contact of facility workers with domestic and (or) wild birds or visits by workers of facilities where birds are kept and belonging to compartments I, II is excluded;

h) within a radius of 500 meters there are no objects assigned to compartments I and II;

i) within a radius of 1 km there are no objects assigned to compartments I and II;

j) there is no entry of unauthorized persons and entry of unauthorized vehicles into the territory of the facility.

25.3.1. Compartment III includes objects that have had Compartment III status for no more than three years from the date of the last examination for compliance with Compartment III, or confirmed the status of Compartment III before the expiration of the period.

25.4. Compartment IV includes facilities that process poultry products in accordance with the requirements of the legislation of the Russian Federation that meet the criteria listed in paragraph 25.3 of these Rules, as well as the following criteria:

a) the facility does not import or process products derived from birds raised in facilities assigned to compartments I-III, or slaughtered in facilities assigned to compartments I-III;

b) the vehicle is not used for the transport of birds;

g) the territory of the object is fenced in a way that excludes the penetration of wild animals;

h) within a radius of 1 km there are no objects assigned to compartments I and II;

25.4.1. Compartment IV includes objects that have had the status of compartment IV for no more than 3 years from the date of the last examination for compliance with compartment IV, or confirmed the status of compartment IV before the expiration of the period.

VI. Compartmentalization of facilities that store products obtained from birds

26.1. Compartment I includes objects that are not assigned to other compartments or prior to their Survey.

26.2. Compartment II includes facilities that store products in accordance with the requirements of the legislation of the Russian Federation and meet the following criteria:

a) the facility does not store products from birds raised in Compartment I facilities and/or slaughtered in Compartment I facilities and/or processed in Compartment I facilities and/or stored at facilities assigned to compartment I;

b) the vehicle is not used for the transport of birds;

products from birds kept and/or killed in facilities assigned to compartment I;

products from birds manufactured in facilities assigned to compartment I,

products from birds kept in facilities assigned to compartment I,

26.3. Compartment III includes facilities that store products in accordance with the requirements of the legislation of the Russian Federation that meet the criteria listed in paragraph 26.2 of these Rules, as well as the following criteria:

a) the facility does not store animal products derived from birds raised in facilities assigned to compartments I and II and/or slaughtered in facilities assigned to compartments I and II and/or processed in facilities assigned to compartments I and II, and/or stored in an object assigned to compartments I and II;

b) the vehicle is not used for the transport of birds;

c) the transport that carries out the export of products is washed and disinfected before entering the facility or is not used for transportation:

26.4. Compartment IV includes facilities that store products in accordance with the requirements of the legislation of the Russian Federation that meet the criteria listed in paragraph 26.3 of these Rules, as well as the following criteria:

a) the facility does not store poultry products derived from birds raised on the facility assigned to compartments I-III and/or killed on facilities assigned to compartments I-III and/or processed at facilities assigned to compartments I -III, and / or stored in objects assigned to compartments I-III;

b) the vehicle is not used for the transport of birds;

c) the transport that carries out the export of products is washed and disinfected before entering the facility or is not used for transportation:

26.4.1. Compartment IV includes objects that have had compartment IV status for no more than three years from the date of the last examination for compliance with compartment IV, or confirmed the status of compartment IV before the expiration of the period.

VII. Final provisions

27. Appeal against actions (inaction) and decisions of officials carried out (taken) during compartmentalization is carried out in accordance with the legislation of the Russian Federation.

28. In the event that one of the diseases listed in paragraph 23.3 occurs at the facility, as well as if during the visit a non-compliance of the facility with at least one of the above compartmentalization criteria is revealed, the zoosanitary status assigned to the facility is reduced. The relevant information is recorded in the Help and entered in the List of objects.

The object within a period of not more than three years has the right to submit an Application.

29. An object may apply for inclusion in a compartment with a higher animal health status at any time. Consideration of this application is carried out in the same manner as the application specified in paragraph 4 of these Rules.

The General Director of the Association of Meat Industry Enterprises of the Agro-Industrial Complex of the Krasnodar Territory "Kubanmyasoprom" addressed me with a letter. The letter contains a number of questions on compartmentalization, the answers to which, I am sure, are of interest not only to the author of the letter. Some of them have already been asked to us, some have not, but in such a summarized form they were received for the first time and therefore we publish a detailed answer directly on the site.

1. Will compartmentalization be recognized without an officially recognized order of the Ministry of Agriculture of the Russian Federation?

I believe that by official recognition of the Order you mean its registration with the Russian Ministry of Justice. If registration occurs, then the Order will come into force and will be "officially recognized", therefore it will be executed. If not registered, then:

A) If the instructions given under the 299th Decree of the Government of the Russian Federation are implemented, in particular, the authority for regionalization is assigned to the Chief State Inspector of the Russian Federation, then the answer to your question is yes, of course.

B) If not, then it CAN BE recognized, but this requires the agreement of ALL Chief State Lighting Inspectors of the constituent entities of the Russian Federation.

PS: Actually, this question of yours does not really matter, as well as my answer to it, since compartmentalization will be accepted.

2. What should be done by meat-packing plants for the purchase of pigs, if the supplying farms have not yet undergone compartmentalization?

Until the completion of the FIRST stage of compartmentalization of the subject of the Russian Federation where the farm-supplier is located, this does not really matter, since the veterinary service of this subject of the Russian Federation is familiar with it.

But to work with this farm (and through it with the veterinary service of this subject of the Russian Federation) in order to carry out compartmentalization, it is necessary to speed up this process for your own good.

3. What list of issues will be considered by the veterinary service when undergoing compartmentalization at meat processing plants? Should the verification be limited only to the study of the economic ties of the meat-packing plant?

No, although this will be the main subject of verification.

The second very important subject of verification is the quality of the workflow of the plant. It must be organized in such a clear and transparent manner as to clearly demonstrate traceability and show the sources of raw materials (including live animals for slaughter).

4. Do the terms of a compartment really apply only when an area is declared unsafe for animal disease?

Not “conditions apply”, but “legal consequences come” when a territory is declared unfavorable. This is in formal terms.

In simple terms, it sounds like this. If the territory is prosperous, then for the enterprise it is absolutely not important to which compartment it belongs. And if the territory is NOT safe, then the disease may be present in compartments 1 and 2 and absent in compartments 3 and 4. Then the latter continue their normal economic activity, and the former are subject to restrictive measures.

5. What regulatory documents provide for the achievement of a temperature of + 80 degrees in the thickness of the product during an exposure of at least 30 minutes (paragraph 2 of the Rules). Industry technological instructions do not provide for the above modes.

None. This is our (authors') mistake (they used a biological standard, but it was necessary to use a technological one). It was necessary to indicate + 72 ° C (as in technology). We will fix this in the future. For now, we will not strictly demand this, since +68 ° C is enough for virus inactivation.

6. To obtain compartment 3-4, one of the conditions is the absence within a radius of 500 meters of farms, other meat processing enterprises and storage places with a lower compartment, that is, criteria that are independent of the meat processing enterprise itself and the elimination of which, in principle, it cannot influence .

Indeed, in this case there are circumstances that are almost independent of the enterprise itself. However, they really and objectively influence its status. And this cannot be changed.

7. Is the presence of economic ties with enterprises supplying live pigs and meat from the Belgorod region a condition for lowering the compartment of these enterprises?

The question is not very clear and not very specific, so I try to rephrase it in two possible ways:

A) Is the presence of economic ties with enterprises supplying live pigs and meat from the Belgorod region, WHERE THE COMPARTMENTALIZATION HAS NOT BEEN CARRIED OUT YET, a condition for lowering the compartment of these enterprises?

9. According to p.p. "a" and "b" of clause 15.4 and clause 16.4 of the Rules, it will be possible to attribute the meat processing plant to the 4th compartment only after 1 year, that is, at present it is practically impossible. Or, as an exception, will the assignment of compartment 4 currently be carried out without taking into account this deadline, due to the absence of such requirements before?

Certainly not counting. This period will be taken into account a year or more after the implementation of compartmentalization in our lives.

10. The release of finished products, especially to wholesale buyers, is made from warehouses located on the territory of meat processing enterprises, therefore it is impossible to exclude the entry of unauthorized persons and the entry of unauthorized vehicles into the territory of the meat processing plant

If you asked EXACTLY what you wanted, then your question (or rather the statement) is not true. Does not correspond, because with the competent organization of the territory of the enterprise, the warehouses of finished products are either taken out of the enterprise, or a partition is made for them. The entry of unauthorized vehicles directly into the territory of the enterprise is unacceptable.

11. How will worker contact with domestic (wild) pigs or visits by persons working in lower compartment holdings be verified?

I don't know how the enterprise will implement this. If I were the administrator of the enterprise, I would insert this requirement into the contract and periodically check it with the help of veterinarians and the security service. Other approaches can also be used.

The State Veterinary Service will check by any available and legal means, the essence of which is likely to change depending on specific conditions and specific demographics.

12. What documents should be required from the inspection bodies that carry out, including scheduled inspections, in order to exclude a downgrade?

The representative of the inspection body should be required to provide an identity document, an official ID, a receipt that this person has not visited pig farms and has not contacted wild pigs for a specified time.

The receipt is given (based on the most common practice) in the form of filling out the appropriate form, or in the form of a handwritten entry in a special journal.

13. September 20, 2010 Decree No. FS-NV-2 / 11700 of the Deputy Head of Rosselkhoznadzor N.A. Vlasov was issued. on the export of pigs and pig products from the Southern Federal District and the North Caucasian Military District, which prohibit the export of pigs and pig products that meet all the standards and parameters of veterinary and other safety from enterprises and farms classified as compartment 1-3 outside the Southern Federal District and the North Caucasian Military District.

None of the paragraphs of the Rules restricts or prohibits the export and movement of safe products and raw materials from enterprises of any compartment across the territory of the Russian Federation. The restrictions relate to the relationship between the enterprises themselves, assigned to different compartments. Therefore, the Order of the Ministry of Agriculture of the Russian Federation No. 258 of 07/23/2010. "On approval of the Rules for determining the zoosanitary status of pig farms, as well as organizations engaged in the slaughter of pigs, processing and storage of pig products" is illegal and violates the current veterinary and sanitary standards and requirements for meat processing enterprises, restricts entrepreneurial and economic activities of enterprises, violates the legislation of the Russian Federation in terms of free competition, as it serves as the basis for the adoption of such instructions by the leaders of the Rosselkhoznadzor.

The Rules mentioned in your question and my instructions have no direct connection with each other. From this it is obvious that the presence of an indication in no way makes the Order unlawful, since the order is not the basis for it.

The basis for the indication is the requirements of the epizootic situation and the interests of the state in terms of preventing the further spread of ASF.

Moreover, the Order provides additional opportunities for business entities, and does not at all restrict their rights. If it were not there, then the instruction would have prohibited the export of products FROM ALL FARMS, and not only from the part assigned to compartments 1-3.

As for restrictions on the freedom of entrepreneurship in the context of the spread of a particularly dangerous disease and quarantine, it is a completely common thing - the essence of what is called RESTRICTORY MEASURES (after all, they restrict rights and freedoms!), A tool to prevent the spread of the disease, a tool to reduce the total damage to business community and state from such spread of the disease. Especially in cases such as with ASF, when human activity is the MAIN factor in the spread.

14. At present, bilateral agreements have been concluded with most suppliers of raw materials and consumers of finished products by meat processing plants and the assignment of two entities (a meat processing enterprise and a supplier of raw materials or a consumer) to different compartments cannot legally serve as a basis for terminating contracts, that is, compartmentalization is not prescribed in the Order and the Rules as a basis for unilateral termination of these contracts without force majeure, which will accordingly lead to economic sanctions against meat processing enterprises.

The actions of the authorities that lead to violations of contractual obligations for business are force majeure circumstances, i.e. the very reason you are talking about. If there is no mention of force majeure circumstances (force majeure circumstances) in the contract, then this is a problem of low professional literacy of the lawyer of the enterprise affected by this. But even if they are not in the contract, then the norms of the Civil Law apply, and they say that obligations are terminated by the impossibility of performance if it (the impossibility) is caused by circumstances for which neither party is responsible. I explained this in simple words, and now how it sounds legally correct:

Not true. The actions of the authorities that make it impossible for the parties to fulfill their obligations under the contracts are force majeure circumstances, i.e. the very reason you are talking about.

At the same time, entrepreneurs must be guided by the norms of the Civil Code of the Russian Federation (CC RF).

Thus, Article 416 of the Civil Code of the Russian Federation provides that an obligation is terminated by the impossibility of performance if it is caused by a circumstance for which neither party is responsible.

Part 1 of Article 417 of the Civil Code of the Russian Federation determines that if, as a result of the issuance of an act of a state body, the fulfillment of obligations becomes impossible in whole or in part, the obligation is terminated in full or in the relevant part. The parties that have suffered losses as a result of this have the right to demand their compensation in the manner prescribed by Articles 13 and 16 of the Civil Code of the Russian Federation.

In addition, part 2 of article 417 of the Civil Code of the Russian Federation provides that if the act of the state body on the basis of which the obligation was terminated is declared invalid in the established manner, the obligation is restored, unless otherwise follows from the agreement of the parties or the essence of the obligation and the performance has not lost interest for the creditor.

Thus, the norms of the Civil Code of the Russian Federation clearly regulate the procedure for termination of obligations between economic entities in the event of force majeure circumstances, as well as the procedure for compensation for damage (losses) from their occurrence.

I. General provisions

1. These Rules for determining the zoosanitary status (compartment) of pig farms, as well as organizations engaged in the slaughter of pigs, processing and storage of pig products (hereinafter referred to as the Rules), were issued in order to harmonize the legal acts of the Russian Federation with international standards, provided for by the Decree of the Government of the Russian Federation dated 09/29/2009* N 761 "On ensuring the harmonization of Russian sanitary and epidemiological requirements, veterinary and sanitary and phytosanitary measures with international standards" (Sobraniye zakonodatelstva Rossiyskoy Federatsii, 2009, N 40, art. 4698).

The system of compartments is used to ensure a favorable epizootic status of pig farms of various types and to prevent the spread of contagious animal diseases on the territory of the Russian Federation.

2. These Rules apply to individuals and legal entities engaged in keeping and breeding pigs, as well as slaughtering pigs, processing and storing pig products (hereinafter referred to as farms).

These Rules do not apply to:

individuals and legal entities engaged in the processing of pig products, producing exclusively products of animal origin, subjected during manufacture to heat treatment in a mode that ensures its disinfection (+72 ° C in the thickness of the product with an exposure of at least 30 minutes);

individuals and legal entities storing exclusively products of animal origin subjected to heat treatment in the course of manufacture in the above mode;

individuals and legal entities engaged exclusively in the storage of pig products for the purpose of retail trade.

3. Determination of the zoosanitary status of holdings (hereinafter referred to as compartmentalization) is carried out on the basis of an analysis of the risks associated with the spread of pathogens of infectious animal diseases, including diseases common to humans and animals, and human infectious diseases, for which pigs can serve as an active or passive carrier, and characterizes the degree of protection of the compartment.

4. According to the results of compartmentalization, the farm belongs to the following compartments:

compartment I - farms unprotected from threats;

compartment II - farms of a low level of protection;

compartment III - farms of medium level of protection;

compartment IV - farms of a high level of protection.

The assignment of the farm to compartments II-IV is carried out based on the results of a visit to the farm, carried out at the request of the farm, drawn up according to the attached sample (Appendix N 1).

The holdings that have not submitted an application and until they are visited belong to compartment I.

5. After the completion of compartmentalization on the territory of the constituent entity of the Russian Federation, the decision to introduce restrictive measures (quarantine) provided for by Article 17 of the Law of the Russian Federation of 14.05.93 N 4979-1 "On Veterinary Medicine" (Bulletin of the Congress of People's Deputies of the Russian Federation and the Supreme Council of the Russian Federation, 1993, N 24, item 857; Collected Legislation of the Russian Federation, 2002, N 1, item 2; 2004, N 27, item 2711; N 35, item 3607; 2005, N 19, item 1752; 2006, No. 1, item 10; N 52, item 5498; 2007, N 1, item 29; N 30, item 3805; 2008, N 24, item 2801; 2009, N 1, item 17, 21) , are accepted taking into account the zoosanitary status of farms.

II. Preparation of the compartmentalization procedure and its implementation

6. After a decision is made to carry out compartmentalization on the territory of a constituent entity of the Russian Federation, within a period of not more than 10 working days, according to the attached sample (Appendix No. 2), a list of individuals and legal entities engaged in keeping and breeding pigs, as well as slaughtering pigs, processing and storage of pig products located on the territory of the relevant subject of the Russian Federation (hereinafter referred to as the List of Farms), which is sent to the Chief State Veterinary Inspector of the Russian Federation, to the Federal Service for Veterinary and Phytosanitary Surveillance and is published for review in public information and telecommunication networks (including the Internet ).

7. The Federal Service for Veterinary and Phytosanitary Surveillance, within 7 working days from the date of receipt of the List of farms, forms a consolidated list of farms in the Russian Federation (hereinafter referred to as the Consolidated List) and places it on its official website.

Changes, additions to the Consolidated List are made by the Federal Service for Veterinary and Phytosanitary Surveillance no later than 7 working days after receipt of information about the introduction of changes, additions to the List of farms.

8. The start of compartmentalization of the farms included in the List of farms is notified in writing no later than one working day before their visit.

9. All holdings included in the List of Holdings and the Consolidated List are assigned to Compartment I until a decision is made to assign them to compartments with a higher animal health status.

10. In accordance with Article 9 of the Law of the Russian Federation of May 14, 1993 N 4979-1 "On Veterinary Medicine", farms are visited in order to verify their compliance with the legislation of the Russian Federation in the field of veterinary medicine, to carry out anti-epizootic and other veterinary measures.

Upon receipt of the application specified in paragraph 4 of these Rules, a visit to the farm provided for in this paragraph of the Rules is organized.

11. Based on the results of the visit to the farm, a certificate is drawn up, which contains information on the compliance of the farm with the criteria for compartmentalization.

location address;

types of activities carried out;

the time of the visit provided for in paragraphs 4, 10 of these Rules;

assessment of the compliance of the farm with the criteria for compartmentalization (for each criterion).

If the farm is recognized as complying with the criteria for assignment to compartments III or IV, the certificate is agreed within 2 working days by the head or deputy head of the territorial body of the Rosselkhoznadzor in charge of veterinary issues.

a) pigs from compartment I (including genetic material and temporary introduction of pigs for any purpose) are not imported into the farms and within 3 months before the visit to the farms provided for in paragraphs 4, 10 of these Rules;

b) the farms are not connected and within 3 months before the visit to the farms provided for in paragraphs 4, 10 of these Rules, were not technologically connected with compartment I (transport, personnel, packaging, veterinary specialists, etc.), with the exception of the supply from this farms in compartment I pigs and pig genetic material;

c) walking of pigs outside the territory of farms is not carried out;

d) the territory of the holdings is fenced in a way that prevents the penetration of wild animals (with the exception of birds and small rodents);

e) there is no entry of unauthorized persons and entry of unauthorized vehicles into the territory of farms;

f) farms do not use food waste for animal feed.

13.3. Compartment III includes holdings that meet the criteria listed in paragraph 13.2 of these Regulations

a) pigs from compartments I and II (including genetic material and temporary introduction of pigs for any purpose) are not imported into the farms and within 6 months before the visit to the farms provided for in paragraphs 4, 10 of these Rules;

b) the farms are not connected and within 6 months before the visit to the farms provided for in paragraphs 4, 10 of these Rules, were not technologically connected with compartments I and II (transport, personnel, packaging, veterinary specialists, etc.), with the exception of the supply from this holding to compartment II holdings of pigs and pig genetic material;

c) the possibility of contact of farm workers with domestic and (or) wild pigs or visits by workers of farms belonging to compartments I and II is excluded;

e) there are no holdings belonging to compartments I and II within a radius of 500 meters;

h) entrance to the production premises of farms is carried out with a complete change of clothes and shoes;

i) only feed and feed additives subjected to sterilizing treatment, heat treatment (granulation) are used in feed for farm animals;

j) farms keep records of incoming feed, indicating their manufacturer and preparation modes;

k) in farms, all veterinary measures and procedures carried out with pigs are taken into account;

l) prior to the visit to farms provided for in paragraphs 4, 10 of these Rules, there were no cases of the following infectious diseases of pigs among the livestock of farms:

African swine fever - within the last 12 months;

classical swine fever - within the last 12 months;

vesicular disease - within the last 12 months;

transmissible gastroenteritis - during the last 2 years;

parvovirus infection - within the last 12 months;

foot and mouth disease - within the last 12 months;

brucellosis - during the last 6 months;

trichinosis - within the last 6 months;

leptospirosis - during the last 3 months;

m) the possibility of carrying food products by personnel working on the farm to the territory of the enterprise is excluded;

13.3.1. Compartment III includes farms assigned to compartment III before the introduction of restrictive measures (quarantine) in them in connection with the occurrence of African swine fever, meeting the following criteria:

Veterinary rules for the implementation of preventive, diagnostic, restrictive and other measures, the establishment and lifting of quarantine and other restrictions aimed at preventing the spread and eliminating foci of African swine fever, approved by order of the Ministry of Agriculture of Russia dated May 31, 2016 N 213, registered by the Ministry of Justice of Russia on August 24, 2016 , registration N 43379 (hereinafter - the Veterinary Rules);

13.4. Compartment IV includes holdings that meet the criteria listed in paragraph 13.3 of these Regulations and the following criteria:

a) pigs from compartments I, II and III (including genetic material and temporary introduction of pigs for any purpose) are not imported into the farms and within 12 months before the visit to the farms provided for in paragraphs 4, 10 of these Rules;

g) entrance to the production premises of the farms for at least 12 months prior to visiting the farms provided for in paragraphs 4, 10 of these Rules, is carried out through a sanitary checkpoint with full sanding, change of clothes and shoes;

h) work clothes on farms are washed daily directly in the clean production area of ​​the farm;

i) the feed delivery vehicle is not used to deliver feed to holdings in compartments I, II and III;

j) among the livestock of farms during the 2 years preceding the visit to the farms provided for in paragraphs 4, 10 of these Rules, there were no cases of salmonellosis, as well as hemophilic polyserositis and pleuropneumonia, and there were no cases of detection of respiratory coronavirus, as well as swine influenza virus (excluding infection swine strains of human influenza A virus);

k) on the farm, in pursuance of the instructions of specialists in the field of veterinary medicine, measures are organized to prevent and combat animal diseases.

13.5. Compartment IV includes farms that had the status of compartment IV before the introduction of restrictive measures (quarantine) in them in connection with the occurrence of African swine fever, meeting the following criteria:

a) a set of measures provided for by the Veterinary Rules was carried out on the farms;

b) at least 8 months have passed since the cancellation of the restrictive measures (quarantine) established in the farms in connection with the occurrence of African swine fever;

c) biological control of animals has been carried out in the holdings in accordance with paragraph 41 of the Veterinary Rules;

d) the reasons for the introduction of the African swine fever virus into the farm are established and eliminated and measures are taken to prevent such introduction in the future.

14. Compartmentalization of farms that slaughter pigs

14.1. Compartment I includes farms that are not assigned to other compartments, or before their visit, provided for in paragraphs 5, 11 of these Rules.

14.2. Compartment II includes farms that slaughter pigs in accordance with the requirements of the legislation of the Russian Federation and meet the following criteria:

a) is not carried out even within 1 month before the visit to the farms provided for in paragraphs 4, 10 of these Rules, paragraph 13.1 of these Rules;

b) the transport is not used and within 1 month prior to the visit to the farms provided for in paragraphs 4, 10 of these Rules, was not used to transport pigs raised in the farms specified in paragraph 13.1 of these Rules.

14.3. Compartment III includes holdings that meet the criteria listed in paragraph 14.2 of these Regulations and the following criteria:

a) is not carried out and within 3 months prior to the visit to the farms provided for in paragraphs 4, 10 of these Rules, the slaughter of pigs grown in the farms specified in paragraphs 13.1 and 13.2 of these Rules was not carried out;

b) transport is not used and within 3 months prior to visiting the farms provided for in paragraphs 4, 10 of these Rules, paragraphs 13.1 and 13.2 of these Rules;

d) the possibility of contact of farm workers with domestic and (or) wild pigs or visits by workers of farms belonging to compartments I, II is excluded;

g) there is no entry of unauthorized persons and entry of unauthorized vehicles into the territory of farms;

h) there is no visit to the production premises of farms where pigs are kept by persons (including specialists in the field of veterinary medicine and officials of bodies authorized to exercise state control (supervision) who have been in contact within 2 weeks prior to the visit to the farms provided for in paragraphs 4, 10 of these of the Rules, with domestic and (or) wild pigs (including visits to game farms, participation in the hunting of wild pigs) that visited farms belonging to compartments I and II, epizootic foci, or participated in anti-epizootic measures aimed at eliminating infectious diseases of pigs .

15. Compartmentalization of farms processing pig products

15.1. Compartment I includes farms that are not assigned to other compartments, or before their visit, provided for in paragraphs 4, 10 of these Rules.

15.2. Compartment II includes farms that process pig products in accordance with the requirements of the legislation of the Russian Federation and meet the following criteria:

paragraph 13.1 of these Rules; paragraph 14.1 of these Rules;

paragraph 14.1 of these Rules.

15.3. Compartment III includes holdings that meet the criteria listed in paragraph 15.2 of these Regulations and the following criteria:

a) the farms do not process pig products obtained from pigs raised on the farms specified in clause 13.2 of these Rules, or slaughtered on the farms specified in clause 14.2 of these Rules;

b) transport is not used for the transportation of pig products obtained from pigs obtained in the farms specified in paragraph 14.2 of these Rules;

c) farms are not connected with compartments I, II technologically (transport, personnel, packaging, veterinary specialists, etc.);

d) the possibility of contact of farm workers with domestic and (or) wild pigs or visits by workers of farms belonging to compartments I, II is excluded;

e) the territory of the holdings is fenced in a way that excludes the penetration of wild animals;

f) within a radius of 500 meters there are no farms specified in paragraphs 13.1, 13.2 of these Rules;

g) there is no entry of unauthorized persons and entry of unauthorized vehicles into the territory of farms.

15.4. Compartment IV includes holdings that meet the criteria listed in paragraph 15.3 of these Regulations and the following criteria:

a) the farms do not process pig products obtained from pigs raised on the farms specified in clause 13.3 of these Rules, or slaughtered on the farms specified in clause 14.3 of these Rules;

b) transport is not used for the transportation of pig products obtained from pigs obtained in the farms specified in paragraph 14.3 of these Rules;

c) farms are not connected with compartments III technologically (transport, personnel, packaging, veterinary specialists, etc.);

d) the territory of the farms is fenced in a way that excludes the penetration of wild animals;

e) within a radius of 500 meters there are no farms specified in paragraph 13.3 of these Rules;

f) no restrictive measures (quarantine) were introduced in the farms for at least 12 months prior to the visit to the farms provided for in paragraphs 4, 10 of these Rules;

g) the farm operates under the supervision of a veterinary inspector.

16. Compartmentalization of farms storing pig products

16.1. Compartment I includes farms that are not assigned to other compartments, or before their visit, provided for in paragraphs 4, 10 of these Rules.

16.2. Compartment II includes farms that store pig products in accordance with the requirements of the legislation of the Russian Federation and meet the following criteria:

a) in farms, pig products obtained from pigs grown on farms specified in paragraph 13.1 of these Rules, paragraph 14.1 of these Rules, paragraph 15.1 of these Rules are not stored;

b) transport is not used for the transportation of pig products obtained from pigs grown on farms specified in clause 13.1 of these Rules, killed on farms specified in clause 14.1 of these Rules, or processed on farms specified in clause 15.1 of these Rules.

16.3. Compartment III includes holdings that meet the criteria listed in paragraph 16.2 of these Regulations and the following criteria:

paragraph 13.2 of these Rules, killed in the farms specified in paragraph 14.2 of these Rules, or processed in the farms specified in paragraph 15.2 of these Rules;

paragraph 13.2 of these Rules, killed in the farms specified in paragraph 14.2 of these Rules, or processed in the farms specified in paragraph 15.2 of these Rules.

16.4. Compartment IV includes holdings that meet the criteria listed in paragraph 16.3 of these Regulations and the following criteria:

a) the farms do not store pig products obtained from pigs raised on the farms specified in clause 13.3 of these Rules, killed on the farms specified in clause 14.3 of these Rules, or processed on the farms specified in clause 15.3 of these Rules;

b) the transport is not used for the transportation of pig products obtained from pigs raised on the farms specified in paragraph 13.3 of these Rules, slaughtered on the farms specified in paragraph 14.3 of these Rules, or processed on the farms specified in paragraph 15.3 of these Rules;

c) the farm operates under the supervision of a veterinary inspector.

IV. Final provisions

17. Appeal against actions (inaction) and decisions of officials carried out (adopted) during compartmentalization is carried out in accordance with the legislation of the Russian Federation.

18. If one of the diseases listed in paragraph 13.3 occurs on the farm, and also if during the visit it is revealed that the farm does not meet at least one of the compartmentalization criteria listed in paragraphs 13.2-13.4, the zoosanitary status assigned to the farm is reduced. The relevant information is recorded in the certificate and entered in the List of farms, the Consolidated List.

19. A holding may apply to be assigned to a compartment with a higher animal health status. Consideration of the specified application is carried out in the same manner as the application specified in paragraph 4 of these Rules.

Over the past week, 16 new cards on agriculture and food production have appeared on the Federal Portal of Draft Regulatory Legal Acts. Five of them at once are methodological recommendations and instructions for the examination and evaluation of GMOs. Seven more deal with veterinary supervision - compartmentalization and the status of enterprises.

Compartmentalization

A compartment is the zoosanitary status of an enterprise. According to the document, which appeared on March 27, it will be assessed for all cattle, including zebu, yaks and buffaloes, as well as storage, slaughter, processing and production of meat and milk.

Scientific institutions;
- processing enterprises that produce only products where the raw materials have been disinfected (+63°C for 30 minutes or more effective for dairy products, and +72°C in the thickness of the product with an exposure of at least 30 minutes or more effective for other products from cattle);
- enterprises that store products that have undergone such processing;
- enterprises selling exclusively such products.

There will be 4 types of compartments in total. There will be different requirements for processing, storage, processing and production. Below we summarize the requirements for milk production.

Compartment I is the unprotected production. Prior to being surveyed or not surveyed, all holdings are assigned to this compartment.

Compartment II - farms of a low level of protection. It includes production, fenced from the penetration of wild animals, not technologically connected with farms that belong to compartment I and entry is prohibited to outsiders. Also, food waste should not be used for food, and special pastures should be used for walking. Pig walking is not allowed.

Cattle, small cattle and pigs, their milk, genetic material are not imported to such farms and within 3 months before the inspection were not imported from compartment I

Compartment III are medium-level security establishments. All previous rules apply to this compartment, plus production must not be technologically connected to the previous two compartments for at least 3 months and such farms are located at least 500 meters from them. Workers do not come into contact with such enterprises and wild animals.

Such production is reliably protected from the penetration of wild animals and has a staff of veterinary specialists. All animals are tested at least once a year for tuberculosis, brucellosis, enzootic leukemia and there were no following contagious animal diseases:

Foot and mouth disease, enzootic leukemia - within the last 12 months;
bovine spongiform encephalopathy within the last 7 years;
contagious pleuropneumonia, vesicular stomatitis, bluetongue - within the last 24 months;
infectious nodular dermatitis - during the last 3 years;
brucellosis, tuberculosis - during the last 6 months;

Compartment IV are farms with a high level of protection. All the requirements described above are met, plus workers take a shower before work and go to production in overalls, work clothes are processed daily. Businesses with other compartments are at least 2 km away.

Walking animals is prohibited, all feed is strictly controlled. Food is supplied by transport that does not work with previous compartments.

The explanatory note states that compartmentalization is necessary to ensure a favorable epizootic situation and prevent animal diseases.
