On January 1, 2014, Federal Law No. 426-FZ “On Special Assessment of Working Conditions” came into force. This normative act mentions for the first time the term “expert of an organization conducting a special assessment of working conditions.” Organization expert - a person who has “passed certification for the right to perform work on the service “” and has an expert certificate for the right to perform work on a special assessment of working conditions” (Article 20, clause 1 of Federal Law No. 426).

Federal law imposes requirements on experts of an organization conducting a special assessment of working conditions, which are as follows:

  1. “having a higher education;
  2. availability of additional professional education, the content of the additional professional program of which includes studying the issues of assessing working conditions in an amount of at least seventy-two hours;
  3. having practical experience in the field of assessing working conditions, including in the field of certification of workplaces based on working conditions, for at least three years” (Article 20, clause 3 of Federal Law No. 426).

An expert is an integral key unit of an organization conducting a special assessment of working conditions. The organization must have “at least five experts” (Article 19, clause 1 of Federal Law No. 426). All NCOT experts have the necessary experience (from three to ten years) in the field of assessing working conditions and meet all the requirements of current legislation.

Training process and certification of SOUT experts

The National Center for Labor Safety, having well-established quality management systems () and an operating Corporate Training Department, conducts training and assessment of the knowledge of experts in all departments of the company in accordance with established requirements. Thus, on January 15, 2014, the NCOT issued an order on training with subsequent certification of knowledge in the field of assessing working conditions.

The process of training and certification for the qualification of “expert” in a special assessment of working conditions consists of the following stages:

  • publication of the Regulations and Order on training and certification;
  • education;
  • check of knowledge on approved issues/tickets (certification) with the participation of the Commission NCOT and an independent expert;— publication of an Order on the results of certification and awarding the qualification “expert” to those who have successfully passed the knowledge test;
  • familiarization with the job description of the SOUT expert;
  • presentation of a Certificate of qualification as an “expert”.

In addition to training and certification in assessing working conditions, NCOT experts receive additional knowledge in such areas as customer focus, the negotiation process, the basics of document flow, and the contractual process.

Why do you need a SOUT registry?

The register is needed to search for organizations or experts providing SOUT services, as well as to check any organization to find out whether it has the right to provide such services or not.

Previously, we wrote that companies that have jobs must conduct a special assessment of working conditions when creating a job, and then, once every 5 years. At the same time, according to Russian legislation, the assessment cannot be carried out independently. Requirements for organizations included in the register

According to Resolution No. 599 of June 30, 2014, firms that meet the following requirements are placed in the register of accredited labor protection organizations:

— the company has a testing laboratory, which is necessarily accredited by the Federal Accreditation Service;
— the company employs at least five experts who have been certified to conduct special assessments. An employment contract must be concluded with each expert. At least one of the experts must have a higher education as a doctor in the field of occupational health.

The register of SOUT experts includes persons who meet the following requirements:

— the expert must have higher education;
— in the absence of specialized education, the expert must have confirmation of advanced training in relevant training programs for assessing working conditions lasting at least 72 hours.
— the expert must be able to assess working conditions and have at least 3 years of work experience in the field of labor protection, including in the labor protection system.

What information does the Ministry of Labor's register on SOUT contain?

According to the Rules for the admission of organizations to carry out special assessments of working conditions, approved by Decree of the Government of the Russian Federation of June 30, 2014 N 599 The following information is entered into the register of organizations conducting a special assessment of working conditions:

— the name of the organization and its location, as well as the name and location of its branches (additional offices);
— TIN;
— OGRN;
— company registration number;
— the date when the company is entered into the register of the Ministry of Labor according to SOUT;

What law requires maintaining a register of SOUT?

The register of organizations conducting a special assessment of working conditions is formed on the basis of Article 21 of the Law on Special Assessment of Working Conditions N 426-FZ dated December 28, 2013 N 426-FZ.

The article says that information about organizations conducting special assessments should be posted on the Internet in an open manner so that anyone can obtain information. The list should be available on the official website of the government body responsible for policy in the field of labor legislation (website of the Ministry of Labor and Social Protection of the Russian Federation).

Requirements for organizations conducting SOUT

Let us note that the law also provides for transitional provisions for experts. Due to the fact that the training of experts and their subsequent certification in the Ministry of Labor takes a lot of time, the provisions on Special Labor Standards allow persons working in organizations under an employment contract and admitted to work in testing laboratories as of the day the Federal Law came into force to perform the duties of experts, but no later than December 31, 2014.

Liability insurance by organizations according to SOUT

Each organization can provide fulfillment of its obligations related to the risk of property liability for obligations arising from damage to employers and employees through voluntary insurance.

When developing the federal law, more precisely, in the first version of the bill, the requirements of this paragraph were mandatory for all organizations. Without compulsory insurance, organizations were not allowed to carry out work under SOUT. But the certifying organizations were able to defend their right, and the clause of the law has already become voluntary.

Register of organizations conducting special assessments

All information about the activities of organizations conducting SOUT is stored in the public domain on the official website of the Ministry of Labor in a special register. It contains the following information:

  • Full name of the organization and location;
  • Main state registration number;
  • Registration number of the entry in the register of organizations;
  • Date of entering information about the organization;
  • The date of the decision to suspend activities and the grounds for its adoption;
  • The date of the decision to resume activities with the grounds for resumption.

If a decision is made to terminate the organization’s activities in the field of provision of services and work on SOUT, an entry is also made in the register and the legal grounds for this are given.

Article 19. Organization conducting a special assessment of working conditions

1. The organization conducting a special assessment of working conditions must meet the following requirements:

1) an indication in the organization’s statutory documents as the main type of activity or one of its types of activity to carry out a special assessment of working conditions;

2) the presence in the organization of at least five experts working under an employment contract and having an expert certificate for the right to perform work on a special assessment of working conditions, including at least one expert with a higher education in one of the specialties - general hygiene, occupational hygiene, sanitary and hygienic laboratory tests;

3) the presence as a structural unit of a testing laboratory (center), which is accredited by the national accreditation body in accordance with the legislation of the Russian Federation on accreditation in the national accreditation system and the scope of accreditation of which is conducting research (tests) and measurements of harmful and (or) hazardous factors production environment and labor process provided for in paragraphs 1 - 11 and 15 - 23 of part 3 of article 13 of this Federal Law.

Article 19. Organization conducting a special assessment of working conditions

An organization conducting a special assessment of working conditions has the right to conduct research (tests) and measurements of harmful and (or) dangerous factors in the working environment and the labor process, provided for in paragraphs 12 - 14 and 24 of part 3 of Article 13 of this Federal Law, if the research (tests) and measurements of these factors is the scope of accreditation of its testing laboratory (center), independently or by engaging under a civil contract to conduct research (tests) and measurements of these factors, testing laboratories (centers) accredited by the national accreditation body in accordance with the law Russian Federation on accreditation in the national accreditation system.

Legislative acts

What information does it contain?

According to the Decree of the Government of the Russian Federation dated June 30, 2014 No. 599, the register of organizations engaged in SOUT must be included following information:

Requirements for organizations

This provision is regulated by Resolution No. 599, according to which organizations that meet a number of requirements:

  2. The company must employ at least five specialists who have passed certification and can carry out SOUT. In this case, an employment contract must be signed with each specialist. In addition, one of the experts must have a higher medical education (specialization in occupational health).

The register of SOUT specialists displays persons who meet the following requirements:

  1. The specialist must have a higher education.
  2. In the absence of specialized education, the specialist is obliged to have documents confirming advanced training in educational institutions with a program lasting at least three days.
  3. The specialist must have at least three years of experience in the field of occupational safety and health, this also includes experience in the labor protection system.

Order of conduct

Inspection of working conditions at enterprises is carried out, as a rule, in in a strictly regulated manner:

  1. Identification of potentially harmful and dangerous production factors.
  2. Conducting research on identified factors (laboratory tests, measurements, etc.).
  3. Setting the hazard class.
  4. Summing up and presenting results.

A protocol on the studies and measurements carried out must be drawn up in relation to each identified dangerous factor, after which the report is signed by all participants of the special commission and certified by its chairman.

If at least one member of the commission does not agree with the results, he can put his opinion in writing and attach it to the report.

Expert level assessment results

According to the results of the audit, the company that conducted the expert assessment, is obliged to indicate classes of current conditions. At the moment there is only four classes:

  1. Optimal (lowest level of exposure to harmful factors).
  2. Valid.
  3. Harmful.
  4. Dangerous.

The employer must organize familiarization of employees with the report of the SOUT commission at their places of work, against personal signature within 30 calendar days. This period does not include the period of temporary incapacity for work of a specialist, stay on vacation and business trips.

After which, the data obtained as a result of checking the SOUT, in accordance with legislative norms, must be transferred to Federal State Information Accounting System.

In turn, the organization that conducted the SOUT within 10 calendar days from the moment the report is certified, must also submit it to the appropriate Federal database. The report must be sent electronically with a certified certified electronic signature of the manager.

Checking documents and concluding an agreement

All responsibility for timely SOUTH in the organization rests with the employer.

The full set of documentation that will be required to verify the SOUT is established on an individual basis and largely depends on the characteristics of the company. Legislatively established minimum list of documents, which are needed for the commission.

The process of preparing documentation for SOUT occurs during the organizational stage. Before concluding an agreement with a company that will conduct an inspection of the organization, the employer must:

  1. Create a commission on SOUT.
  2. Confirm the composition of this commission.
  3. Develop a work schedule.
