In what cases is a European protocol drawn up in case of an accident. Simplified registration of traffic accidents: the experiment with the European protocol continues. How can a victim receive a payment under the European protocol?

In case of an accident, drivers are obliged to remove vehicles from the roadway if only cars were damaged in the accident and this interferes with the movement of other road users. You must first fix the location of the cars using photo or video recording.

If the guilt of any of the participants in the accident is in doubt or the participants in the accident do not agree with its circumstances, you must call the police (telephone 02, 112 or 911) and follow the instructions of the police officer. Further, the participants in the accident (at the direction of the police inspector) follow for registration of an accident either to the nearest traffic police post, or to the nearest duty station of the traffic police, where the accident is registered.

If there is no dispute about guilt, and the nature and list of damage to vehicles does not cause controversy, the participants independently (without contacting the police) record the incident and follow to the nearest traffic police post or to the duty department of the traffic police for further registration of the accident and obtaining the necessary documents.

In this case, it is necessary to fix the location of vehicles, collision traces and binding to stationary objects (houses, shops, etc.).

You can do without registration of an accident at all if the vehicles or other property of only the participants in the accident are damaged and each of these participants does not need to draw up these documents. For example, each car is insured under comprehensive insurance, damage is minimal, and certificates are not needed to receive insurance compensation (according to insurance rules) (check this item with your insurance company). Either the damage is minimal (scratches or abrasions) and the participants in the accident are not going to apply for compensation and have no claims against each other. In this case, the consent of the drivers is required. It is enough to issue such consent in the form of a receipt, where it is indicated that the participants have no claims against each other and there is no need to file an accident.

If the damage is small (read more about how to assess the degree of damage in our article), you can file an incident without the participation of police officers according to the European Protocol.

To do this, it is necessary to fill out an accident notification form, which is attached to the OSAGO policy (as a rule, it is handed over to the insured at the conclusion of the OSAGO agreement).

Mandatory conditions for registration of an accident according to the European protocol

Damage limit:

  • 25 thousand rubles - if at least one of the OSAGO agreements of the participants in the accident was concluded before 08/02/2014;
  • 50 thousand rubles - if the contracts of both participants are concluded after 08/02/2014;
  • 400 thousand rubles - from 10/01/2014 for Moscow, Moscow region, St. Petersburg and Leningrad region, if the accident was recorded using a DVR. DVRs must be equipped with systems that record the fact of an accident and its place using global navigation satellite systems (GLONASS or other systems until January 1, 2017, after this date - GLONASS or GLONASS together with other systems).
IMPORTANT: If it later turns out that the amount of damage is greater than the above limits, the victim has the right to file a claim for compensation for the missing amount directly from the culprit.
Having issued an accident according to the European protocol, you can contact the insurance company and the hull policy. In this case, the limit on the amount of payment will be the same as in OSAGO.

Other mandatory conditions for issuing a Europrotocol include:

  • no harm was caused to the health of participants in the accident (including passengers and pedestrians);
  • two vehicles were involved in the accident (important: if one of the vehicles is with a trailer, it is impossible to issue according to the European Protocol!);
  • both drivers have valid OSAGO policies (check that the second participant in the accident is included in the policy), for foreign cars a Green Card is required (when the owner's liability is insured in accordance with the international liability insurance system);
  • all the circumstances of the accident, its nature, the list of damages, the degree of guilt, and so on, do not cause disagreement among the two participants in the accident (if there is even the slightest dispute, you will have to file an accident either at the traffic police post or with the participation of traffic police officers on the spot. The absence of disagreements is confirmed by signatures two drivers - participants in the accident in the notice of the accident.

Features of registration of an accident according to the European protocol

Photo and video recording

Photo or video filming must be done no later than 60 minutes after the traffic accident.

What should be recorded:

  1. State registration plates of vehicles of participants in a road traffic accident or identification numbers (VIN) (in the absence of state registration plates of vehicles);
  2. Vehicle damage;
  3. The location of the vehicles involved in the road traffic accident with reference to transport infrastructure facilities or other non-movable objects (houses, shops, etc., so that the street name and house number can be seen).

Filling out the Europrotocol form (accident notifications)

Both drivers fill out one notice of an accident. The notification form is self-copying. One driver fills in column "A", the other - column "B". After filling in the front side of the notice, the form is separated - one copy for each driver. On the back, drivers fill out each of their forms.

Front side of the accident notice

The front side of the notice should contain information about the place, date, time of the accident, information about the participants in the accident, about witnesses, about insurers, about the nature and list of visible damaged parts and elements, the circumstances of the accident, etc. (all columns and fields available on the front side of the Accident Notice form must be filled in).

Clause 14 indicates the nature and list of all visible damage to car parts. We indicate briefly all the damage (for example, a dent on the left front fender). Hidden damage will be identified and described when the car is inspected by experts after contacting the insurance company.

In paragraph 15 "Remarks" you can specify additional information if something was not indicated in paragraph 16 "Circumstances of an accident".

In paragraph 16, the circumstances of the accident are noted (in the large cells located below, the number of marked cells is filled in). Fill out carefully. If the car was stationary during the collision, mark the appropriate box (cell).

In paragraph 17, an accident scheme is drawn up. Vehicles after an accident are schematically fixed and the direction of movement of each until the moment of collision is indicated.

The notice is signed by each driver in clauses 15 and 18.

The reverse side of the accident notice

The reverse side of the notice each driver fills out independently.

Empty columns can be marked with a dash. After signing and separating the forms, no changes, corrections or additions are allowed.

After registering an accident and filling out the Europrotocol form, it is advisable to make a copy of your copy. On the way, a traffic police inspector can stop you and ask about the cause of the broken car. In this case, it will be sufficient to show a copy of the notice of the accident.

Actions of drivers after registration of an accident according to the European protocol

Victim

Within five working days, the victim applies to his insurance company and passes to the insurer:

1) a form of notification of a traffic accident;

2) an application for direct compensation for losses (filled in in any form, or (most often) a sample is provided by the insurance company, where you need to fill in the necessary columns);

3) electronic media with information (memory card with photo or video recording from the accident scene). This indicates that you did not make changes to the photo and (or) video, that is, the information is uncorrected.

culprit

Submit an accident report form to your insurance company. Within fifteen days from the moment of the accident, he has no right to repair his car. If you need to start repairs, you need to provide the car for inspection to the insurance company of the victim or obtain permission to begin repairs.

How do I fill out an accident report form?

Both drivers fill out one accident notification form: the front and back sides are required.
In this case, it does not matter which of the participants in the accident the form will be filled out. Each driver selects any column and enters information on his vehicle.

  • 1. Place of the accident: indicate the city, street and number of the building closest to the accident; if the accident occurred at the intersection - the intersection of streets; if not in the settlement - the name of the route, kilometer and direction of movement.
  • 2. Accident date: mark the date and time of the accident.
  • 3. The number of damaged vehicles: there should be only two, otherwise call the traffic police.
  • 4. In the column "Number of wounded / dead" there should be dashes, otherwise the application of the Europrotocol is unacceptable.
  • 5. Examination of participants in an accident for intoxication: when registering the Europrotocol is not carried out.
  • 6. Material damage caused to other vehicles (except for "A" and "B"): if other property was damaged in addition to two vehicles, registration of the Europrotocol is unacceptable.
  • 7. Witnesses to the accident: indicate the contact details of witnesses, if any (if possible, take written statements from them about the circumstances of the accident).
  • 8. Whether registration was carried out by a traffic police officer: “no”, since the Europrotocol is drawn up without the participation of police officers. Further, each participant in the accident fills out his side (“A” or “B”).
  • 9. Make, model of the vehicle: data from the certificate of registration of the vehicle.
  • 10. Owner of the vehicle: details of the person whose name appears on the registration certificate, including address.
  • 11. Driver of the vehicle: the data of the person who was driving the vehicle at the time of the accident (may differ from the data of the owner of the vehicle) are indicated.
  • 12. Insurer: indicate the insurance company from the OSAGO policy, the policy number and the expiration date.
  • 13. Place of initial strike: Only the place of initial strike is indicated.
  • 14. Nature and list of visible damage: all visible damage is indicated.
  • 15. Comments: indicate which of the participants in the accident pleaded guilty, and the innocent must indicate his innocence.
  • 16. Circumstances of the accident: specify from those proposed. Be sure to note the total number of filled cells.
  • 17. Accident scheme: it is necessary to mark the contours of the carriageway with the obligatory indication of street names, as well as the direction of movement. Indicate the location of vehicles, road markings, road signs, signs, traffic lights - everything that is related to the accident.
  • 18. Signatures of drivers certifying the absence of disagreements on paragraphs. 14, 15, 16, 17 - a prerequisite for registering an accident using the Europrotocol.

If there is not enough space on the back of the form for a full description, write down
the necessary data on a blank sheet of paper and attach it to the main form.
On the form it is necessary to make a mark "With the application", and on the application indicate,
what document it refers to and by whom it was drawn up, as well as certify it
signatures of both participants in the accident, as well as on the front side of the form.

In the current 2019, drawing up in case of an accident is a common decision among drivers. But there remains a fear of drivers to face unpleasant consequences due to ignorance of the nuances of the procedure. What is the main thing you need to know about the requirements for the form of the European Protocol, in what cases it can be called into question and what obligations lie with the participants in the incident.

Why and when compiled

The issue of reimbursing the cost of car repairs without calling the traffic police to the accident site is caused by:

  • saving time (the entire registration procedure takes no more than an hour, which is even less than waiting for the arrival of the traffic police, not to mention the preparation of documents by them);
  • preventing the formation of traffic jams on the roadway, as well as avoiding a fine for obstructing the traffic flow. Recall that the SDA provides for the obligation of drivers to clear the roadway in case of minor damage;
  • convenience for motorists. When an agreement is reached, you do not need to take a word, exchange receipts, etc. All circumstances will be indicated in an official document, which cannot be refused;
  • pay a fine for violation of traffic rules in connection with the accident. After all, traffic police officers not only record the situation of an accident, but attract to the adm. responsibility of the guilty driver. By the way, therefore, not only the victim, but also the culprit should be interested in drawing up the protocol;
  • the europrotocol is also suitable for cases of payments under CASCO.

One of the conditions under which the Europrotocol can be drawn up is the amount of compensation after an accident. It should not exceed a certain value, from June 2018 to October 2019 the amount is 100 000 rub. Thus, the simplified procedure applies only to minor accidental damage.

In addition, it is important to comply with other requirements provided by the legislator.:

  1. there must be two participants in the accident, and each of them has a valid OSAGO policy. If one of the drivers is with a trailer, then it is considered that this is one vehicle;
  2. there are no disagreements not only on the amount of damage, but also on all circumstances, and most importantly, on establishing the guilt of one of the drivers. However, if there are still disagreements, then when fixing the scene of an accident using the technical means of ERA-GLONASS or using the AIS RSA program (technical means of control that fixes in an uncorrectable way the situation of an accident: coordinates of the place, time, existing damage, etc.), you can do without the presence of representatives of the traffic police. Photos and other data are uploaded by at least one driver to the database of the association of motor insurers and small disagreements of drivers will not be an obstacle to drawing up a Europrotocol under a simplified procedure;
  3. what happened is described in detail and confirmed by both;
  4. no casualties (damage caused to only one or both cars, but not to people);
  5. other property was not damaged (road signs, coatings, fences, large green spaces, nearby buildings, etc.);
  6. The accident happened on the territory of the Russian Federation. In other countries, even members of the Eurasian Economic Union, the rules are different.

If the situation falls under these signs, you can use the right to a simplified settlement of the conflict on the road. Otherwise, when the circumstances of the accident did not correspond to the listed points, the insurance company will refuse to pay.

Example. Petrov V.V. and Ivanov A.A. collided with their cars. As a result, damage was caused to the car of Ivanov A.A. (Petrov V.V., by their mutual agreement, was found guilty). Since there were no disagreements on all the main issues, the amount of the alleged damage was less than the maximum amount (100,000 rubles), the men drew up a European protocol. Subsequently, it turned out that the collision of two cars of these citizens also caused damage to an outsider, or rather, to his car. So, with a failed maneuver, the car of Petrov V.V. lightly hit a truck parked nearby. Since more than two people were involved in the accident, the insurance company refused to pay. An appeal against this decision did not bring a positive result. Here, even the conscientious error of drivers who objectively did not notice the damage to the third car will not be taken into account.

In practice, there are many nuances that make it difficult to use an abbreviated method of resolving damages issues, because:

  • not all drivers (especially pensioners) have smartphones with video cameras that can correctly fix the position in case of an accident;
  • many drivers see the protocol for the first time exactly when an accident has already happened - in a stressful situation, therefore they do not have to correctly draw up a document, carefully and calmly read the form. At best, the traffic police will be called (“I’d better wait, but everything will be recorded correctly”), at worst, the form will be filled out with violations. What will call into question the real payment to the victim;
  • inexperienced drivers generally do not know about this method of resolving the situation on the road. In driving schools, they are just beginning to bring to the attention of students the basic rules of “simplification”.

If there are any features of a psychological or other nature that prevent the use of a simplified procedure, it is better to call the DPS.

Before compiling

Traffic rules provide for a clear sequence of actions in case of any accident, regardless of the call of the inspector to the place:

  1. stop moving;
  2. install an emergency stop sign;
  3. fix the position of objects on the roadway. It is necessary to pay attention not only to damage to cars, but also to buildings, road signs or other landmarks that are nearby. The projection (contours on the pavement) of cars should be outlined with chalk and additionally photographed after the cars are removed from the scene of the accident.

The last duty of motorists is very important when drawing up the European protocol. After all, representatives of the traffic police do not participate in fixing and, accordingly, cannot suggest what to look for. Therefore, photographing (you can also additionally make a video) is necessary from several angles, approximately and separated, in a word - as detailed as possible. The lens should get:

  • the general situation of the accident;
  • relative position of cars;
  • damaged parts of machines;
  • car parts (fragments, mechanisms, decorative elements, stains of technical fluids) on the road;
  • traces of braking;
  • state signs of cars;
  • if possible, the faces of the participants in the accident.

It's best to call the police if you think the other driver is hesitant, not sure about the decision, or the accident is too complicated, or you think that repairs will cost a tidy sum in excess of 100,000 rubles.

With full confidence that all the conditions for the possibility of doing without traffic police are met, you can proceed to the direct filling out of the form. It is issued to each driver when registering OSAGO. You need to use printed forms. If, upon receipt of the policy, a form was not issued, you must contact the insurance in advance to receive it. At worst, print from the official website of the traffic police, an insurance company. You should not use self-made ones, as this may be one of the reasons for refusing to pay a refund.

How to fill out the form correctly

The rules for compiling a European protocol in case of an accident are provided for by the legislation on OSAGO. To avoid questions from the insurer, you must:

  1. correctly identify the location of the accident. We recommend that you indicate: the road number (if any), the street, the number of the nearest house or any public building. If there is an appropriate technique (for example, the ability to use GLONAS), then the best way out would be to indicate the coordinates of the area. By the way, in the Moscow and Leningrad regions, the limit under the European protocol can be more than 100,000 rubles. (up to 400 thousand) in case of using satellite navigation systems. This approach is explained by the high accuracy of localization and the inability to make graphic changes by fraudsters (which cannot be said about ordinary photography - almost any changes can be made to any photo using special applications);
  2. put down the date and time when the accident occurred, using two-digit numerical values;
  3. indicate the number of damaged cars: usually two, but sometimes only one car is damaged;
  4. make a note that other vehicles, as well as people, have not been harmed;
  5. make a list of all eyewitnesses of the accident, indicating their full names, contact numbers and addresses of residence (of course, with consent);
  6. do not forget to write information about your car (the second party writes information about their transport), with the obligatory specification of the brand, model, number and other individual data;
  7. indicate your full name (in full), as well as the data of another person who may have been driving at the time of the accident;
  8. describe all the circumstances preceding the accident: the maneuvers of both participants, the location on the road, etc., draw up a diagram. A schematic representation of what happened is extremely important - it is this evidence that will be the subject of close attention when studying an insured event. Employees of the insurer company will surely compare the scheme with other evidence (testimony of witnesses, photographic data) and, in case of discrepancy, there may be a refusal to satisfy the requirements;
  9. mark the part of the car where the first impact occurred in a collision, indicating specific visible damage;
  10. the appendix may list what supporting evidence can be examined: video recorder data, photographic materials, etc. All this can be analyzed by the insurance company in case of any doubts about the correctness of the protocol;
  11. observe the following:
    • all fields must be filled in. In the event that it is impossible to provide information on some item, then a dash is put;
    • you need to use a simple ballpoint pen with blue ink;
    • avoid mistakes, blots, corrections, strikethroughs;
    • if the handwriting is incomprehensible, it is better to write in block letters;
    • both drivers participate in the compilation, after which, having disconnected the document, each of them takes his notice.

If there is not enough space in the filling form, you can supplement the document with a regular sheet, on which the signatures of both participants in the traffic accident must be affixed.

An article about why and how to draw up an accident according to the European protocol - tips and recommendations. At the end of the article - a video on how to avoid mistakes when compiling the Europrotocol.

The content of the article:

Even minor car accidents cause stress for drivers and raise dozens of questions: “Should I call the police?”, “Am I allowed to move my car?”, “When and how should I file a report?”... According to news agencies and insurance companies, more than 87% of car owners would not like to resort to the help of traffic inspectors in case of minor accidents, but are forced to do so, fearing to make mistakes that will cause the insurance company to refuse to pay.

The Europrotocol, which allows you to independently draw up a document about the accident, is a good solution in large cities. While he was gone, those who stood in kilometer-long traffic jams, waiting for the passage to be cleared, and people who had an accident, who spent hours looking for the summoned representatives of the law, suffered.

What is a Europrotocol, what are the rules for its execution and what "pitfalls" can we expect? In simple terms, this is a document that records all information about an accident. It is issued by the owners of vehicles involved in an accident, mainly for insurance companies, because liability before the law in case of minor damage to equipment and the absence of corpses / seriously injured is minimal.

Having got into this kind of trouble, the participant in the accident must:
  • check yourself for injuries;
  • ensure the well-being of the satellites;
  • place emergency signs;
  • provide all possible assistance to the victims;
  • talk to the other party
  • record all aspects of the accident.
Only two participating cars (a car with a trailer is perceived as one), the adequacy of drivers (sober, physically and mentally healthy) and the absence of seriously injured people (including pedestrians) and / or municipal facilities are necessary conditions for compiling a Europrotocol. Otherwise, "organs" must be called.

In a conversation with the other party, you need to find out that you have no claims against each other, except for property claims, adequately (and without disagreement) assess the degree of guilt and damage, have valid insurance policies and other necessary documents and agree to disperse peacefully.

As for the “aspects of the accident”, we need photo and video recording, data from registrars of both sides and witnesses, written testimonies of onlookers, passers-by, passport data of everyone who participated in the incident and watched it from the side.

Capture everything that may be related to the accident: a general view of the accident from different angles (including from afar, preferably with road signs and traffic lights in the frame), braking distance (measure and photograph), paint chips, broken mirrors and other damaged parts, tire treads (so as not to be accused of driving on unsuitable for the season or worn out tires), car owners and passengers (preferably in full growth to avoid possible claims for injuries later) and other things that seem worthy of attention to you.

You can attach interviews with passers-by to the case. Take a large notepad and a few pens with you - this way you can quickly distribute leaflets to others, asking them to write their full name, date, time and a few words about the incident. At least in the form of "blue Zhiguli were waiting at a traffic light, and a red Zaporozhets ran into them from behind."

The more materials you have on hand, the more relaxed you will feel. Remember that the equipment that contains a record of an accident must be presented to experts in its natural form, it is impossible to overwrite the data on another medium - this gives the insurers the right to challenge their authenticity. You will have to spend time and money on an independent examination, but it is not a fact that this will help.

Filling out the protocol

After you and your opponent have come to the conclusion that the intervention of law enforcement officers is not required, and have done all of the above, clear the roadway and start writing the European protocol. A form of two connected sheets is issued by the insurer at the conclusion of the contract. The instruction is attached. Once you've used up yours, go to your insurance company's office and ask for a new one.

All data on the front side is automatically printed (self-copied) on the second copy, then the form is separated and the reverse side is filled. Whose form will go into action (the culprit or the victim) does not matter, but make sure that your vision of the event does not differ from your opponent (otherwise you will have to call the civil services). In the appropriate columns indicate:

  • the scene of the incident (in detail, up to the number of a neighboring house or a kilometer on the highway);
  • date and time;
  • the number of participants in the accident (no more than 2);
  • “no” in the column on the dead and wounded (if any, the Europrotocol cannot be drawn up);
  • "no" in the paragraph on the medical examination;
  • "no" in the paragraph on damage to other vehicles;
  • data of eyewitnesses with full name, address and telephone number;
  • “no” in the paragraph on the preparation of the protocol by the traffic police (even if they themselves are participants in the accident);
  • information about both cars and their owners;
  • information about the insurance company and the current MTPL policy (or Green Card for foreign guests);
  • indicate the place of the first strike with an arrow;
  • a list of damages - visible and hidden, indicating the nature (crack, chip, dent, rupture);
  • the alleged degree of guilt of both parties;
  • details describing the moment of the accident;
  • a detailed diagram of the accident with the direction of movement of both vehicles, positions during the collision and after it.
Filled out? Check and both sign. You draw up the second page in splendid isolation, like your neighbor. Specify:
  • own vehicle ("A" or "B" - you designated it that way when filling out the first page of the protocol);
  • circumstances of the incident with a brief description of the collision and the events preceding it (again indicate the date, time, address, etc.);
  • details of who was driving the car at the time of the accident;
  • whether the car is able to move after the accident under its own power.
  • availability of relevant written materials, photos and videos.
An autograph and date complete the document. Write calmly, legibly, try to avoid mistakes and corrections of any kind, so that they do not result in a denial of damages. Do not leave a single column empty - fill in with a dash or the letter "Z". Enter the “Appendix” that does not fit into the main description. Signatures of both parties must be on all important points.

Did you manage? Shake hands and go home. Do not forget to send the document to the insurer's office as soon as possible (you have 5 working days). Mentally prepare for car inspections by representatives of the insurance company or other experts. With the repair of the car, you will have to wait 15 calendar days or ask permission from the insurer.

When the victim receives financial compensation, he will not be able to present any claims against the culprit in this incident, except to file a lawsuit, declaring harm to health that was imperceptible at the time of the accident and subsequently manifested. It is difficult to prove this, but some lovers of nerves never give up pleasure, so in case of an accident, exchange receipts for no claims in the future.

Who can help with paperwork

Many drivers are still afraid to draw up a European protocol on their own for fear of making a mistake, as a result of which the insurance company will refuse to pay. Driving schools have begun teaching self-registration of accidents, and those who have not undergone special training are offered the services of a hotline and contact centers.

Operators work around the clock and in addition to paperwork, they can help with finding parking lots and public transport stops, as well as tell you where to send an appeal, complaint or proposal. Check with any traffic inspector or insurer for the latest service numbers in your area.

People can still exercise their civil rights and call the traffic police to the scene. At least theoretically. In the absence of victims and the participation of no more than two cars, they are strongly advised to sort it out on their own, without resorting to the services of a traffic police.

On the one hand, innovations make life easier for drivers, eliminating the additional stress of communicating with not always loyal representatives of the law and reducing the time required to file an accident.

But, adding two plus two, we see that the traffic police simply took off the extra burden, because there are much fewer bloody accidents on the roads than ordinary collisions. The workload is reduced - you can also reduce the staff. There will be much fewer police patrols on the roads. A lot of their functions will be taken over by drivers and automatic traffic cameras.

Saving budgetary funds is, of course, wonderful, but drivers will begin to en masse hide license plates under a layer of dirt and drive without fear of stationary cameras and other people's DVRs. There will be no one to stop them, and the punishment for an unreadable license plate is ridiculous - you can brazenly provoke an emergency. In the end, respectable citizens on the roads will receive a large-scale "hello from the 90s."

Let's touch on the financial side. At present, European protocols give the right to compensation for losses only up to 50,000 rubles (in Moscow, St. Petersburg and adjacent areas - up to 400,000).

Insurers are promising to look into higher payouts, but for now, they're trying to convince car owners that most accidents are under $50,000 and there's no need for more to fix bumper cracks and minor scratches.

Yes, this is a way out for a man on a battered Lada. But sometimes even a minor accident costs a pretty penny: one replacement of deployed airbags can cost more, not to mention damage to expensive parts of luxury cars. What could not be covered by insurance, the victims will recover from the culprit. Through the court or bandits.

Legislative bodies, the Ministry of Finance and insurers continue to refine the rules and calculations as part of the registration of minor accidents under the European protocol. Plans for the near future contain three important innovations.
  1. This protocol will apply to accidents involving more than two cars.
  2. It can be issued even if the drivers did not agree on the definition of the culprit of the accident and its circumstances.
  3. From July 1, 2018, the amount of payments in most regions of the Russian Federation should increase from 50 to 100 thousand rubles. But this provision will be valid subject to the availability of modern equipment and mobile applications in vehicles, which in a sense should replace the traffic police, linking to the accident site and informing the insurer about the accident in real time.

Many Russians are worried that all this could provoke chaos on the roads. Car owners are taught to be independent and honest, but there are a lot of people who want to get insurance “out of the blue” and deliberately create an emergency.

It is unlikely that such progressive innovations will appeal to respectable drivers. But the traffic police are delighted - the load on them has decreased several times, which cannot but rejoice, especially taking into account some reduction in staff. They are most interested in promoting and developing new practices, because with the growth of the country's car park, the number of "minor" traffic accidents in just one decade after the introduction of OSAGO has increased several times.

Despite everything, the popularity of the Europrotocol is growing. According to the RSA, if before the introduction of amendments to the rules of the road (in particular, to the procedure for registering a traffic accident), about 12 thousand participants in an accident used it every month, then at present (according to data at the end of 2017 - beginning of 2018), their number increased to 38 thousand per month.

The share of accidents registered under the European protocol in Moscow was about 6% until July 2017, and already in October it exceeded 21%. At the moment, in some regions of the Russian Federation, the figure reaches 46-55%, and by the middle of 2018, according to forecasts, it should reach 62-68%.

Video on how to draw up a European protocol without errors:

The legislation of the Russian Federation provides for the possibility of registering an accident without calling the police according to the so-called "Euro protocol", when both participants fill out a notice of a traffic accident and sign it. We will now tell you how to do it correctly in order to get insurance.

In accordance with paragraph 5 of Art. 11, paragraph 1 of Art. 11.1 Federal Law "On OSAGO"; clause 2.6.1 of the traffic rules of the Russian Federation, independent registration of an accident in 2020 is possible only if the following conditions are simultaneously met:

  • damage caused by the accident only vehicles involved in an accident (no harm to life or health);
  • The accident was the result of a collision two vehicles (including vehicles with trailers to them), the civil liability of whose owners is insured under the OSAGO policy;
  • the circumstances of causing harm in connection with damage to property as a result of an accident and (or) the nature and list of visible damage to cars do not cause controversy participants in the accident.

According to paragraph 4 of Art. 11.1 of the Federal Law “On OSAGO”, when drawing up documents about an accident without the participation of traffic police officers, the amount of insurance compensation due to the victim in compensation for damage caused to his car cannot exceed 50 000 rub. The victim must understand that the insurance company will pay only this amount, even if the actual damage is greater.

In case of registration of documents about an accident that occurred in Moscow, St. Petersburg, Moscow and Leningrad regions, insurance compensation to the victim is carried out within 400,000 rubles. subject to the provision to the insurer of data on the circumstances of causing damage to the vehicle as a result of an accident, which are recorded using technical means of control that provide uncorrectable registration of information (photo or video filming of vehicles and their damage at the scene of an accident, as well as data recorded using navigation tools operating using the technologies of the GLONASS or GLONASS system in conjunction with other global satellite navigation systems) (clause 5, article 11.1, clause “b” of article 7 of Law N 40-FZ).

In accordance with clause 2.6.1 of the traffic rules of the Russian Federation, participants in an accident right not to issue documents about the incident, if the vehicles or other property of only these participants are damaged in the accident and each of them does not need to draw up these documents.

The procedure for registration of an accident according to the European protocol

Pull yourself together and follow these steps in sequence:

  1. Inspect the scene of the accident together with the second participant in the accident (the driver of the second car). Find out if you have disagreements about who is the perpetrator and who is the victim. If there are no disagreements, then go to step 2. Otherwise, we call the traffic police.
  2. Check for damage to vehicles. If the damage to the victim's car, according to a rough estimate, does not exceed 50,000 rubles, follow the instructions further. If the damage is more than the specified amount, it is worth registering an accident only with the participation of the police.
  3. Carefully check the documents - driver's license, car documents. Both drivers must have valid OSAGO policies and be inscribed in them (if the number of drivers allowed to drive the vehicle is limited). Problems with documents - without hesitation we call and wait for inspectors. Yes, according to the “OSAGO rules”, it is the responsibility of the driver to communicate the insurance policy data to other participants in the accident at their request. We strongly recommend checking the policy of the culprit on the PCA website - https://dkbm-web.autoins.ru/dkbm-web-1.0/bsostate.htm
  4. Record all the circumstances of the accident - the location of cars, damage, markings, road signs, etc. This can be very useful in case of disputes. Fixation of harm can be carried out with the help of photography or video filming or with the use of navigation aids. A smartphone with geolocation enabled is suitable. Enable adding coordinates to pictures and/or videos in your phone's camera settings.
    In accordance with clause 3 of the Rules for submitting information about a traffic accident to an insurer, approved by Decree of the Government of the Russian Federation of 01.10.2014 N 1002, photo or video filming must be performed within no more than 60 minutes after the accident and include images:
    state registration plates of vehicles involved in the accident or identification numbers (VIN) (in the absence of state registration plates of vehicles);
    places of damage to the vehicle;
    the relative position of the vehicles involved in the accident with reference to transport infrastructure facilities or other non-movable objects;
    the state registration plate of the vehicle of the witness of the accident (if any).
  5. Remove vehicles from the roadway. According to clause 2.6.1 of the SDA of the Russian Federation, the driver involved in an accident is obliged to clear the roadway if an obstacle is created for the movement of other vehicles. Failure to comply with this obligation may result in a fine (1000 rubles).
  6. Jointly fill out the form of the Europrotocol - notification of an accident. Read detailed instructions below.
  7. Exchange phone numbers, shake hands and you can leave the scene of the accident.
  8. Notify your insurance company as soon as possible. This can be done by phone or through the website of the insurer.

Instructions for filling out an accident notice

The notification form is filled in two copies - one for each of the drivers. It is highly desirable to use a ballpoint pen, since when filling out the information is copied onto the sheet from the bottom. The color of the ink can be any - blue or black.

Front side filling

This side must be identical on both copies of the notice. We start with points 1 - 8:

p.1 Location of the accident - indicate the settlement, street and number of the nearest house. If the collision occurred at an intersection, then the intersection of streets is noted on the form. In the event of an accident on the highway, you must indicate its number and name, direction of travel and approximate kilometer.

p.2 Date of the accident - fill in the date and time of the accident. If there is a DVR recording, then the exact time of the collision can be viewed there. If there is no record, write the time approximately.

p.3 Number of damaged vehicles = 2. Registration of the Euro protocol is possible only in the event of a collision between two vehicles.

Clause 4 Number of wounded = 0. The Europrotocol cannot be issued if there are wounded or dead. In the presence of victims, it is imperative to call the traffic police inspectors.

Clause 5. Whether the road accident participants were examined for intoxication - “No”. Only police officers can send for a medical examination.

p.6 Material damage caused to other vehicles (except for "A" and "B") - "No". This will be another proof that only two units were involved in the accident. If transported items (for example, a laptop) are damaged in the car, be sure to check the “other property” box.

Clause 7 Witnesses to the accident - enter the names and addresses of witnesses. It is advisable to indicate the contacts of one or two witnesses to the accident, this will help in case of disputes with the insurance company.

Clause 8 Was the registration carried out by the traffic police officer - “No”. Self-registration of the incident is the essence of the European protocol.

Having filled in the "header" of the notice, we proceed to fill in the information about the cars:

p.9 Make, model, VIN and state. We take the number for vehicles "A" and "B" from the relevant registration certificates (plastic card).

p.10-11 We indicate the data of owners and drivers of cars. You need to understand that the driver of the vehicle does not have to be its owner. The insurance company will compensate the damage not only to the owner, but also to the person who has a power of attorney with the right to receive insurance compensation.

Clause 12 We take data from OSAGO insurance policies. We tick the box next to “Vehicle insured against damage” only if this car is insured under CASCO.

p.13 We mark the place of the initial blow with an arrow.

item 14 We write visible damage. For example: rear bumper burst, deformed: rear left fender, rear door, rear lights broken, etc.

item 15 Remarks. At this point, the culprit of the accident NECESSARILY should write: “I admit my guilt in an accident”, and the victim “is innocent in an accident”.

After filling out paragraphs 9 - 15, we proceed to the central part of the notification form. Here you need to check the boxes next to the circumstances of the accident (each car has its own) and draw a diagram:

Try to reflect on the diagram the road profile, markings, signs, the position of cars before and after the accident, the direction of movement. There are no special requirements for the drawing, the diagram just needs to be clear.

Don't forget to put signatures in the appropriate fields at the bottom of the document.

Back side filling

First separate the original and the copy of the notice (a copy is created automatically on the second sheet of the notice). The victim usually takes the original, as everything is more clearly visible on it.

If the front side should be identical on both copies, then on the back side each participant fills in the information regarding his car, marking "A" or "B". As you can see, there are fewer points here.

As you can see, the rules for filling out the Europrotocol are quite simple.

What to do after filling out the Europrotocol?

So, the document is completely filled out and signed by both drivers - there are no mutual claims, which means you can continue driving. But the rights and obligations associated with an accident do not stop there. According to the current legislation, both the victim and the perpetrator must submit notices to their insurance companies within 5 days. The culprit must also be ready to show his car to the insurer, otherwise the insurer has the right to present recourse claims. We wrote more about this, as well as about the risks that arise when registering a European protocol. We strongly recommend reading!

In addition to a copy of the accident notice form filled out by drivers, the victim, in accordance with paragraph 2 of Art. 11 of the Federal Law “On OSAGO” and clause 2 of the OSAGO rules approved by Decree of the Government of the Russian Federation of October 1, 2014 N 1002, within five working days from the date of the accident, the following documents and materials must be submitted to the insurer that insured his civil liability:
claim for direct damages;
electronic media with information containing photo or video recording of vehicles and their damage at the scene of an accident, the date and time of photo or video recording, as well as the coordinates of the location of the technical means of control;
a statement that information containing photographs or videos is uncorrected.
