The church lives on donations - this is a common place, and everyone knows it. Therefore, all funds transferred to the Church must be treated precisely as donations, that is, disinterestedly transferred. No one forces a person to make donations: please go to church, pray, confess, take communion, without spending a penny of your money. And not a single priest has the right to refuse to perform any sacred act free of charge. However, this priest needs to eat and drink, the temple in which services are performed needs to be repaired and maintained. People understand this and make donations to the temple.

Some selflessly sacrifice, others selflessly perform sacred acts - this is the ideal, and such an ideal is feasible under one condition - church tithes. Let every Orthodox person give a part of his income to the Church - and it can easily live, develop its social initiatives, engage in charity very widely and distribute candles left and right to everyone in need. Maybe someday church-social relations will come to such a norm, but for now we have what we have. The practice of fixed donations.

In general, “taxes” for fulfilling requirements, that is, worship services at the request, according to the needs of people (baptism, funeral services, etc.) are not a church institution. They were introduced into the practice of the Russian Orthodox Church under Catherine I. This was part of a very broad campaign of secularization, when the state took away church lands, introduced various states for the maintenance of churches and monasteries... Behind all these events shines a clear desire to control church income. Once placed in such an uncomfortable position, the Church has not been able to free itself from it until now.

Today the state does not force the Church to set a certain amount of donation, but the role of a limiter in the return to “unstandardized donations” is played by the persistent de-churchism of our people. Here is one real-life example on this topic. A certain priest decided to offer candles in his church not for a fee, but for a voluntary contribution: he put the candles and placed a donation box next to it. The next day there were no more candles, because a rumor spread throughout the village that the church was giving out free candles, and everyone rushed to stock up for future use. This is the spiritual level of most “believing” people. So the Church is always ready to return to normal relations of donation, but our de-churched society is not yet.

The following can be said about the wealth of priests: the priest lives the way his flock lives. If a priest serves in the capital and bankers go to his church, this is one level of donations and, accordingly, the priest’s income, but if the church is rural, then it is completely different. Now answer the question: b O Do the majority of people in our country now live rich or poor? This is exactly how priests live. Something is not observed around the churches of those who want to work in them on a permanent basis, and this is quite explainable by the very modest level of wages. And the priest in this sense is no exception.

Purpose of spending money in the Church

Monetary expenses in the Church are the payment of wages to temple employees (and all related taxes). Yes, the Church pays taxes to the state and feeds it. A third of the expenses are various acquisitions: those same candles, as well as icons, literature, which are subsequently offered for distribution when collecting donations. A significant portion of the church budget is payment for utilities: gas and electricity. The light of chandeliers (chandeliers) is very expensive! Next are the costs of maintaining a charitable refectory and, in addition, a Sunday school, comparable to this “piece”. Add here the necessary repairs, maintaining communication networks in order, office and other expenses, and you will see that church money disappears like water into sand. In addition - charity and contributions to general church needs. Finding a hole in the church budget the size of the cost of a Mercedes is the stuff of science fiction. The wealth of the Church is a myth. At one time, I heard that to ruin the Russian Orthodox Church it is enough to take only one measure - to transfer the maintenance of the Cathedral of Christ the Savior in Moscow to its balance sheet. (The entire temple complex is the property of the city of Moscow; the city government manages and receives income from the operation of some commercial components of the complex.) The costs of its maintenance are comparable to the size of the general church budget! Now tell me: is this budget large and huge?

The Church is poor, and so poor that more than 90 percent of the buildings that once belonged to it are ruins, which the Church is now unable to return and restore. The Church is just coming to its senses after the terrible years of godlessness that literally bled it dry; it is trying to get back on its feet. Yes, a priest may turn out to be unworthy of his rank, but Judas was also among the apostles, and it is not by him that we evaluate the moral level of the apostles! So I propose to judge the priesthood not by articles in the yellow press, but by real and, thank God, numerous examples of simple Russian priests, who combine good nature, non-covetousness, selflessness, often fearlessness and much more, which allows the people to talk about the priesthood as special people and place particularly high moral demands on the priests.

Donation to the temple in the form of money

Our prayer request to God must be supported by a willingness on our part to bring something as a gift. This has been known since the earliest biblical times. This is the spiritual meaning of sacrifices and various types of donations. Therefore, already in the ancient Church people made monetary contributions. Holy John Chrysostom explained to those who in his time did not understand the meaning of fees: “Don’t be embarrassed - heavenly blessings are not sold for money, they are not bought with money, but by the free decision of the one giving the money, through philanthropy and alms. If these goods were bought with silver, then the woman who put in two mites would not receive much. But since it was not silver, but a good intention that had power, she, showing all her readiness, received everything. So, we should not say that the Kingdom of Heaven is bought with money - not with money, but with a free decision that manifests itself through money. However, you say, do you need money? It's not money that's needed, but a solution. Having it, you can buy heaven for two mites, but without it, even for a thousand talents you cannot buy what you can buy for two mites.”

The donations that believers make have two sides. One is spiritual and moral, and the other is life-practical.

The Lord says about the spiritual side: Sell ​​your property and give alms. Prepare for yourselves sheaths that do not wear out, an unfailing treasure in heaven, where no thief comes near and no moth destroys, for where your treasure is, there will your heart be also(Luke 12:33-34). And St. the apostle Paul writes: You sent me to Thessalonica once or twice for my needs. [I say this] not because I was looking for giving; but I seek fruit that multiplies for your benefit(Phil.4:16-17).

The current generation of believers is cut off from centuries-old tradition. Many have neither the feeling nor the consciousness of conciliarity. Most people come to the temple only to satisfy their spiritual needs. They do not empathize with the life of the parish and the Church as part of their life. They don’t even think about the needs of their home parish. It was different in the ancient Church. St. Apostle Luke says: The multitude of those who believed had one heart and one soul(Acts 4:32). Since the Lord replaced the ritual law with a spiritual law, a spirit of sacrifice is required from a Christian. He should make charitable offerings according to his diligence. St. ap. Paul wrote to the Corinthians: Each one should give according to the disposition of his heart, not grudgingly or under compulsion; For God loves a cheerful giver. But God is able to make all grace abound to you, so that you, always having all sufficiency in everything, may abound in every good work.(2 Cor. 9:7-8).

The donation of a thing or right for generally beneficial purposes is recognized. A benefactor of a religious organization, at his own request and discretion, chooses the form in which he will make a donation:

  • conclusion of a written agreement;
  • transferring funds to a current account anonymously or indicating your data;
  • via SMS message to a short number;
  • replenishment of the piggy bank.

Regardless of the method of donation, the institution must maintain mandatory accounting and tax records of such receipts.

Religion is being actively promoted in our state after more than half a century of its oppression and destruction. Many churches and monasteries were restored or are still being restored by volunteers. Donations to a religious organization are possible both with and without a written agreement.

The legislator obliges to conclude a donation agreement in a written form if only:

  • the benefactor is a legal organization, and the value of the gift exceeds 3,000 rubles;
  • the donor promises to donate in the future.

In other cases, the benefactor is given complete freedom to choose the form of the agreement (written or oral).

When donating to a religious organization, any citizen or legal entity can act as a benefactor. For each of the parties when concluding a donation agreement rights and responsibilities arise.

Donor's rights:

  • control the use of the donation by receiving a report received from the recipient;
  • give a written response if the beneficiary requests permission to use the donation for other purposes not specified in the agreement;
  • may change the purpose of the donation;
  • has the right to demand cancellation of the contract if the gift is used for other purposes.

The procedure for collecting donations for the construction or restoration of the temple

In order to be able to collect donations for the construction or restoration of a temple, it is necessary to register a religious organization with the territorial state registration authority.

Monasteries or churches conduct their economic activities, as a rule, only on donations from citizens or organizations. There are several ways to donate temple for construction or restoration:

  • in the church shop- buying candles, icons or ordering a prayer service or memorial service is a kind of donation, since the proceeds go to the needs of the church;
  • in a piggy bank- donation boxes are often located on the territory or inside the temple; such a piggy bank contains information for what needs the money is collected. Having a desire to help the temple, the donor places money in the piggy bank, the amount depends on the capabilities of the benefactor. This type of donation collection is the most effective, as it is quite simple and does not require the preparation of any documents;
  • concluding a donation agreement with a religious organization - s Any donor, regardless of whether he is an individual or a legal entity, and regardless of the subject of the donation - real estate, cash, movable things, can conclude such an agreement in writing. This method of registration is the most effective, due to the fact that the benefactor can control the use of the gift and, in case of improper use, can terminate the contract.
  • transferring funds to a current account anonymously or indicating your data - in modern conditions, there are various ways of transferring to a current account in cash directly at the bank or non-cash using numerous payment systems, terminals, ATMs, etc. Transfer using various forms on the temple website is used.

Near one of the villages in the Vladimir region there was an inactive temple, which was destroyed during the Great Patriotic War. A local resident of the village of Kuzmin, Vasily Petrovich, had a great disinterested desire to restore this church. However, for this good purpose a large amount of money is needed, which Kuzmin did not possess.

To do this, he, together with his like-minded people, prepared all the necessary documents for registering a religious non-profit organization with the registration authority:

  • statement;
  • list of persons participating in the creation of the institution;
  • charter;
  • minutes of the founding meeting;
  • a certificate confirming the existence of a religious group;
  • document confirming payment of state duty.

The religious organization was registered in the Unified State Register of Legal Entities (USRLE). After which the founders posted information about the need for donations for the restoration of the church, indicating details in the media, and the organization’s website was created on the Internet. After a short time, the church was restored; it became a favorite place for parishioners throughout the area.

Accounting for donations in the temple

A religious organization is primarily a legal entity, so it needs to keep separate records of all incoming donations, regardless of the subject of the gift. As a rule, the bulk of donations arrives through piggy banks, placed on the territory of the temple from parishioners (individuals) anonymously, that is, no data of benefactors is known.

Items that are absolutely necessary indicate in the act of opening the box for donations:

  • place and date of opening the piggy bank;
  • data of the persons drawing up this act;
  • date and number of the decision on the basis of which the piggy bank was installed;
  • how much money and in what currency was discovered when the box was opened;
  • number and date of the receipt order;
  • handwritten signatures of all listed commission members.

Important

When withdrawing donations, it is necessary to issue a cash receipt order, as well as record the transaction in a separate cash book.

If the donation came from a specific benefactor (not anonymously), then a cash receipt order is drawn up at the cash desk of a religious institution indicating the donor’s data (last name, first name, patronymic, passport details, registration address), this operation is also recorded in the cash book.

Donation in the church and its legal significance

After the donation agreement is concluded, two scenarios are possible:

  • If the agreement is in writing, then the benefactor has the opportunity to control the implementation and use of the gift. The beneficiary is responsible for providing a report on the use of the gift. It is drawn up in writing, as a rule, agreed upon in advance and its form is attached to the donation agreement. The report is provided within the time limits specified in the agreement, or at the request of the benefactor.
  • if the donation is made without concluding an agreement, by placing it in a piggy bank or by transferring funds from a mobile phone account. In this case, the benefactor has no opportunity to receive information about the use of the donated gift.

A written donation agreement acts as a kind of guarantor of the rights of the benefactor, with the help of which he can control the use of the donation, and in case of improper use, he can apply it to the recipient sanctions in the form of cancellation of the contract and return of donated property.

Additionally

A donation agreement concluded in writing is a factor that limits the actions of the beneficiary in using the gift, forcing him to use it for its intended purpose and nothing else.

Conclusion

A benefactor can donate to the church:

  • only property belonging to him, money, movable things;
  • only for generally beneficial purposes;
  • only items not withdrawn from civil circulation.

If the subject of the donation is property acquired during marriage by the spouses, the transfer requires the notarized consent of the other spouse, otherwise the agreement is void.

At the entrance to the house, I saw an advertisement that funds were needed to restore the monastery located not far from our city. However, I am worried that these may be scammers who will take the money for themselves rather than use it for the restoration of the holy place. In order to have full control over the use of donated money, it is necessary to conclude a written voluntary donation agreement, in which the recipient is required to provide a report on the funds spent.

As a rule, if the posters of such advertisements are scammers, then they do not indicate except the current account. The advertisement must contain all the details of the legal entity, contact information (telephone, email, website of the organization), that is, feedback is required.

Using the details of a legal entity, it is possible to obtain information about it in the Unified State Register of Legal Entities. Until you are sure that a religious organization is a legal entity, do not transfer donations under any circumstances.

I often visit the monastery, which is located in the Kaluga region, and help the nuns with their household work. I also often make donations to this religious organization through a piggy bank, by sending SMS messages, and sometimes I transfer funds anonymously to the institution’s bank account. Can I get a report from the monastery on the use of donations, due to the fact that I have recently donated a fairly large amount (about 1 million rubles).

Regardless of the amount of the donation, unless a written agreement is concluded, you do not have the right to demand from the recipient an account of the use of the gift. In order to be able to control its use, it is necessary to draw up a written agreement on a voluntary donation with a religious organization, in which the recipient is required to report on its use.

When donating to a religious organization, any citizen or legal entity can act as a benefactor. For each of the parties when concluding a donation agreement rights and responsibilities arise.

Near one of the villages in the Vladimir region there was an inactive temple, which was destroyed during the Great Patriotic War. A local resident of the village of Kuzmin, Vasily Petrovich, had a great disinterested desire to restore this church. However, for this good purpose a large amount of money is needed, which Kuzmin did not possess.

To do this, he, together with his like-minded people, prepared all the necessary documents for registering a religious non-profit organization with the registration authority:

  • statement;
  • list of persons participating in the creation of the institution;
  • charter;
  • minutes of the founding meeting;
  • a certificate confirming the existence of a religious group;
  • document confirming payment of state duty.

The religious organization was registered in the Unified State Register of Legal Entities (USRLE). After which the founders posted information about the need for donations for the restoration of the church, indicating details in the media, and the organization’s website was created on the Internet. After a short time, the church was restored; it became a favorite place for parishioners throughout the area.

Accounting for donations in the temple

A religious organization is primarily a legal entity, so it needs to keep separate records of all incoming donations, regardless of the subject of the gift. As a rule, the bulk of donations arrives through piggy banks, placed on the territory of the temple from parishioners (individuals) anonymously, that is, no data of benefactors is known.

Items that are absolutely necessary indicate in the act of opening the box for donations:

  • place and date of opening the piggy bank;
  • data of the persons drawing up this act;
  • date and number of the decision on the basis of which the piggy bank was installed;
  • how much money and in what currency was discovered when the box was opened;
  • number and date of the receipt order;
  • handwritten signatures of all listed commission members.

If the donation came from a specific benefactor (not anonymously), then a cash receipt order is drawn up at the cash desk of a religious institution indicating the donor’s data (last name, first name, patronymic, passport details, registration address), this operation is also recorded in the cash book.

Donation in the church and its legal significance

After the donation agreement is concluded, two scenarios are possible:

  • If the agreement is in writing, then the benefactor has the opportunity to control the implementation and use of the gift. The beneficiary is responsible for providing a report on the use of the gift. It is drawn up in writing, as a rule, agreed upon in advance and its form is attached to the donation agreement. The report is provided within the time limits specified in the agreement, or at the request of the benefactor.
  • if the donation is made without concluding an agreement, by placing it in a piggy bank or by transferring funds from a mobile phone account. In this case, the benefactor has no opportunity to receive information about the use of the donated gift.

A written donation agreement acts as a kind of guarantor of the rights of the benefactor, with the help of which he can control the use of the donation, and in case of improper use, he can apply it to the recipient sanctions in the form of cancellation of the contract and return of donated property.

A donation agreement concluded in writing is a factor that limits the actions of the beneficiary in using the gift, forcing him to use it for its intended purpose and nothing else.
