3.1 customer: The owners of premises in an apartment building, or a person authorized by the owners, who has more than fifty percent of the votes of the total number of votes of the owners of premises in this building, acting as one party to the agreement being concluded, the management body of a homeowners association, the management body of a housing cooperative or the management body of another specialized a consumer cooperative, a person who has accepted an apartment building from the developer (a person who ensures the construction of an apartment building).

4 General requirements

4.1 The provision of utility services to consumers in the form of electricity, heat, gas, water supply and sanitation is carried out by the contractor in accordance with the legislation of the Russian Federation as part of the execution of an apartment building management agreement, in accordance with GOST R 56038, by concluding agreements with resource supply organizations.

4.2 The composition of the utilities provided to consumers in apartment buildings is determined depending on the availability of designed and installed appropriate in-house engineering and technical support systems, the availability of appropriate engineering networks on the territory where the apartment building is located and their connection to these networks.

4.3 The provision of utility services to consumers in an apartment building begins from the moment established by the housing legislation of the Russian Federation, including in accordance with - taking into account the requirements established in Art.

5 Conclusion of contracts with resource-supplying organizations for the supply of utility resources to an apartment building

The procedure for concluding contracts with resource-supplying organizations for the supply to the point of supply of a communal resource, and the assessment of the quality of the service provided is carried out in accordance with GOST R 56038 clause 5.6.

6 Provision of utility services to consumers

6.1 Public heating service

The heat supply utility service (including the supply of solid fuel in the presence of stove heating) is carried out in accordance with the legislation of the Russian Federation and must provide heat supply to the premises that are part of an apartment building. The heat supply service must be provided around the clock, continuously during the heating period, that is, uninterruptedly or with interruptions not exceeding the duration specified in Appendix N 1.

The provision of heat supply services to consumers in an apartment building is provided by means of:

- conclusion of an agreement with a resource-supplying organization for the supply to the point of supply of a communal resource (thermal energy, coolant), using which the contractor provides consumers with a communal heat supply service;

- control over the compliance of the technical parameters of the utility resource (heat energy and heat carrier) supplied by the resource supplying organization to the point of supply, in accordance with which heat networks were built, according to the temperature schedule in accordance with SNiP 2.01.01;

- performance of work on the maintenance of the intra-house engineering and technical support system, with the use of which the provision of heating to consumers of an apartment building is carried out;

- ensuring the efficient operation of the ventilation system, which provides standard air exchange in the premises and heating of the supply air;

- maintaining and increasing (if necessary) the effectiveness of thermal protection of non-translucent enclosing structures and translucent enclosing structures of an apartment building.

Based on the technical documentation, an instruction manual for the operation of an apartment building should be drawn up, in which there should be a section on the operation and maintenance of the in-house heat supply system.

6.2 Public hot water service

The public hot water supply service for consumers in an apartment building is carried out in accordance with the legislation of the Russian Federation and must provide round-the-clock, uninterrupted hot water supply throughout the year, that is, uninterruptedly or with interruptions not exceeding the duration established in accordance with Appendix N 1.

The provision of hot water utility services to consumers in an apartment building is provided by the contractor as part of the execution of an apartment building management agreement by means of:

- conclusion of an agreement with a resource-supplying organization for the supply to the point of supply of a communal resource, using which the contractor provides consumers with a utility service of hot water supply;

- control for compliance with the technical parameters of the communal resource (cold water, thermal energy used to heat it), including according to GOST R 51232 and;

- performance of work on the maintenance of the in-house engineering and technical support system, with the use of which the provision of hot water supply to consumers is carried out, ensuring that the requirements established and.

Based on the technical documentation, an instruction manual for the operation of an apartment building should be drawn up, in which there should be a section on the operation and maintenance of the hot water supply system.

6.3 Cold water utility service

The public service of cold water supply to consumers in an apartment building is carried out in accordance with the legislation of the Russian Federation and must provide round-the-clock, uninterrupted cold water supply throughout the year, that is, uninterruptedly or with interruptions not exceeding the duration established in Appendix N 1.

The provision of cold water utility services to consumers in an apartment building is provided by the contractor as part of the execution of an apartment building management agreement by means of:

- conclusion of an agreement with a resource-supplying organization for the supply to the point of supply of a communal resource, using which the contractor provides consumers with a utility service of cold water supply;

- control for compliance with the technical parameters of the communal resource (cold water), including GOST R 51232;

- performance of work on the maintenance of the in-house engineering and technical support system, with the use of which cold water supply is provided to consumers in accordance with SNiP 2.04.01.

Based on the technical documentation, an instruction manual for the operation of an apartment building should be drawn up, in which there should be a section on the operation and maintenance of the cold water supply system.

6.4 Municipal sewerage service (disposal of domestic waste water)

The public sewerage service is carried out in accordance with the legislation of the Russian Federation and must provide round-the-clock, uninterrupted sewerage throughout the year, that is, uninterruptedly or with interruptions not exceeding the duration established in accordance with Appendix N 1.

The provision of utility services to consumers in an apartment building is provided by the contractor as part of the implementation of the contract for the management of an apartment building by means of:

- conclusion of an agreement with a resource-supplying organization for the supply to the point of supply of a communal resource, using which the contractor provides consumers with a communal sewerage service;

- control for compliance with the technical parameters of the communal resource that provides water disposal through the engineering and technical support network;

- performance of work (services) in accordance with, SNiP 2.04.01 for the maintenance and repair of the in-house engineering and technical support system, using which the contractor provides consumers with a communal sewerage service.

Based on the technical documentation, an instruction manual for the operation of an apartment building should be drawn up, in which there should be a section on the operation and maintenance of the drainage system.

6.5 Electricity utility service

The utility power supply service for consumers in an apartment building is carried out in accordance with the legislation of the Russian Federation and must provide round-the-clock, uninterrupted power supply throughout the year, that is, uninterruptedly or with interruptions not exceeding the duration established in accordance with Appendix N 1.

The provision of utility services to consumers in an apartment building is provided by the contractor as part of the execution of an apartment building management agreement by means of:

- conclusion of an agreement with a resource-supplying organization for the supply to the point of supply of a communal resource, using which the contractor provides consumers with a utility service of electricity supply;

- control for compliance with the technical parameters of the communal resource, including GOST 13109 and GOST 29322;

- performance of work in accordance with the content of the in-house engineering and technical support system, with the use of which the provision of utility services to consumers is carried out.

Based on the technical documentation, an instruction manual for the operation of an apartment building should be drawn up, in which there should be a section on the operation and maintenance of the power supply system.

6.6 Gas utility service

The utility service for gas supply to consumers in an apartment building (including the supply of domestic gas in cylinders) is carried out in accordance with the legislation of the Russian Federation, including, and must provide round-the-clock, uninterrupted gas supply throughout the year, that is, uninterrupted or with interruptions not exceeding the duration , established in accordance with Appendix N 1.

The provision of utility gas supply services to consumers in an apartment building is provided by the contractor by means of:

- control for compliance with the technical parameters of the communal resource (natural gas, liquefied gas) supplied by the resource supplying organization to the point of supply of the communal resource, defined in GOST 5542, GOST 20448 and;

- performance of work on the maintenance of the engineering and technical support system in accordance with, with the use of which the contractor provides consumers with public gas supply services.

Based on the technical documentation, an instruction manual for the operation of an apartment building should be drawn up, in which there should be a section on the operation and maintenance of the gas supply system.

6.7 Sale and delivery of solid fuels.

Solid fuel is sold and delivered to the consumer in accordance with.

7 Ensuring the provision of public services

As part of the management of an apartment building in accordance with GOST R 56038 and the provision of public services, the contractor provides, among other things:

7.1 Dispatch and emergency maintenance

The contractor provides consumers with round-the-clock dispatching and emergency repair services for the engineering and technical support systems of an apartment building in accordance with GOST R 56037.

The Contractor informs consumers about the addresses and telephone numbers of the dispatching, emergency repair service of the Contractor, integrated and (or) unified dispatching services, if such services have been created.

7.2 Accounting and control of communal resources and utilities

The Contractor ensures, in accordance with the legislation of the Russian Federation, accounting and control of utilities supplied by resource-supplying organizations to the point of supply of utilities and utilities consumed by consumers in an apartment building, based on the standards for consumption of utilities and (or) readings of metering devices, if any.

Installation and commissioning of common house metering devices, individual, general (apartment) or room metering devices in accordance with GOST 8.156 , , , , .

Note - The accuracy class of a common house metering device must correspond to the accuracy class of metering devices installed in premises owned by the owners and vice versa.

7.3 Taking readings from metering devices

The Contractor, in accordance with applicable law, organizes and ensures monthly readings from common house metering devices that take into account the consumption of communal resources supplied by resource supply organizations to the metering point of a communal resource, as well as taking readings from metering devices installed in premises owned by owners, taking into account consumed their utilities.

The contractor must have a developed and approved procedure for taking readings from metering devices and storing the information received. The contractor appoints a person responsible for the performance of these works.

7.4 Documentary confirmation of the fact of the provision of public services of inadequate quality

The Contractor provides documentary evidence of the fact that utility services are provided of inadequate quality.

The procedure for independently establishing the fact of providing utilities of inadequate quality and (or) with interruptions exceeding the established duration, including on the basis of consumer requests, is carried out in accordance with and GOST R 56038 clause 5.13.

Determination of deviations of indicators inside the premises of apartment buildings is carried out in accordance with regulatory legal acts, including GOST 30494-96.

The contractor must have a developed and approved procedure for confirming the fact of the provision of public services of inadequate quality and a person responsible for its implementation must be appointed.

7.5 Documentary confirmation of the fact of supply of a communal resource of inadequate quality

The procedure for establishing the fact of supply by resource-supplying organizations to the metering point of a communal resource that does not meet the technical parameters and (or) with interruptions exceeding the established duration is determined taking into account the requirements of the legislation of the Russian Federation, as well as the terms of the contract concluded by the contractor with the resource-supplying organization and is confirmed by an act that is drawn up within the terms and according to the procedure determined by the legislation of the Russian Federation and the terms of the contract.

Note - If the contractor has installed control devices that have the appropriate permits (certificates) for their use, and which allow you to control the parameters and (or) the volume of the communal resource supplied by the resource supply organization, the deviation of the parameters and (or) the volume of the communal resource recorded by such devices is the basis for recalculation by the contractor of payment for such a communal resource.


The contractor must have a developed and approved procedure for documenting the fact of supply of a communal resource of inadequate quality and a person responsible for its implementation must be appointed.

7.6 Accrual, calculation and recalculation for consumed utility services and utility resources

The procedure for calculating, determining the amount of fees for utilities, recalculating the amount of fees for certain types of utilities during the period of temporary absence of citizens in the occupied residential premises, the procedure for changing the amount of fees for utilities when providing utilities of inadequate quality and (or) with interruptions exceeding the established the duration, grounds and procedure for suspending or restricting the provision of public services, as well as issues related to the onset of liability of contractors and consumers of public services, is carried out in accordance with applicable law.

The contractor must have an information electronic program, using which qualified specialists make accruals and recalculations.



7.7 Suspension or restriction of the provision of utility services to consumers

The procedure for suspending or restricting the provision of utility services to consumers is carried out in accordance with the legislation of the Russian Federation.

When suspending or restricting the provision of utility services to consumers, the contractor must:

- have knowledge of the legislation regulating the procedure for suspending or restricting the provision of utility services to consumers;

- have means and devices with the use of which the suspension or restriction of the provision of public services to consumers is carried out;

- have qualified specialists capable of performing work to suspend or restrict the provision of utility services to consumers in accordance with the requirements of the legislation of the Russian Federation.

Note - The contractor may entrust the execution of work to suspend or restrict the provision of utility services to consumers by a third-party organization that has qualified specialists, the necessary resources and equipment, by concluding an appropriate contract with it.

7.8 Conducting claims and claims work

The Contractor conducts claims and claims work with debtors who do not pay or do not pay in full for the utilities they consumed in an apartment building, including with resource supply organizations, if they supply a communal resource that does not meet the requirements established in the contract, as well as with other participants in contractual relations that improperly fulfill the terms of contracts in the provision of public services.

The performer must have qualified specialists.

Note - The Contractor may conclude an appropriate agreement with a specialized organization.

7.9 Organization of energy saving and energy efficiency measures

Works (services) on energy saving and energy efficiency improvement are carried out in accordance with , , .

Note - In cases where in an apartment building the amount of accruals for utilities, including for general house needs, exceeds the relevant norms for the consumption of utilities for general house needs established in the region, or when the customer has a need to reduce utility costs, the contractor may offer the customer to conclude an energy service contract in accordance with and, the condition of which should be a reduction in the consumption of utilities in an apartment building, including for general house needs.


The contractor must have qualified specialists with experience in developing programs and measures for energy saving.

8 Requirements for the contractor in the provision of public services

When providing a utility service, the contractor must:

- appoint responsible persons for the conclusion and maintenance of contracts with resource-supplying organizations for the supply of communal resources, providing:

a) establishment in the contract with resource supplying organizations of the relevant technical parameters supplied to the point of supply (metering point) of communal resources;

b) establishing, on the basis of the requirements of the legislation of the Russian Federation, an understandable and economically justified procedure for recalculating (reducing) payment, in the event that a resource supplying organization supplies a low-quality communal resource;

Note - The Contractor in its composition must have qualified specialists with special knowledge in solving economic, legal and technical issues, including calculation and charging for consumed communal resources.


- the availability of qualified specialists by the contractor, who ensure the normative technical condition of the in-house engineering and technical support systems.

Note - The contractor may entrust the performance of work on the maintenance of in-house engineering and technical support systems to a third-party organization that has qualified specialists and the necessary resources by concluding an appropriate contract with it.

9 Quality control of the provision of public services

The following methods are used to control the quality of services provided:

- visual control (examination of the premises available to the contractor, the equipment used, the availability of technical and other documentation);

- analytical (documentation analysis - the content of contracts, acts of inspections, logs of control and accounting of applications, acts of acceptance of work);

- sociological (consideration of complaints, consumer survey, questioning, etc.)

- comparative (analysis based on archival documents, photographs, acts, logs of applications and reports, allowing you to track changes in the technical condition of an apartment building, its parts, customer (consumer) satisfaction, improving living comfort, reducing energy consumption, lowering the level of payments);

- monitor the efficiency of the contractor's specialists and services in the provision of public services, check the culture of service, including on the basis of regular checks of logs maintained by dispatch services.

To improve the quality of the provision of public services, the contractor must:

- improve the skills of specialists by sending them to advanced training courses, master classes, ensure their participation in training seminars, etc.;

- conduct consumer surveys, following which take measures to eliminate deficiencies;

- monitor the implementation of established and adopted regulatory documents and requirements;

- to reduce terms of performance of the applications arriving from consumers;

- exchange positive experience with organizations working in the field of housing and communal services;

- to introduce quality management systems at the enterprise;

- carry out certification of specialists and works;

- apply in the work of electronic programs for managing an apartment building, calculations, charges, formation and maintenance of technical documentation for an apartment building;

- monitor among organizations supplying communal resources (if any), choosing those who have stable, most favorable conditions, have good reviews and reputation.

1. The standard of the normative living space used to calculate the subsidy (approved by the Law of the City of Moscow dated November 1, 2006 No. 54 On the standards of the city of Moscow used in determining the rights of citizens to provide subsidies for paying for housing and utilities

2. Standard for the cost of housing and communal services. In accordance with the Decree of the Government of Moscow dated
December 4, 2018 No. 1499-PP "On approval of the size of the standard for the cost of housing and communal services" from January 1, 2019 4 types of standards for the cost of housing and communal services have been established in Moscow:

For users of residential premises in the state or municipal housing stock, tenants of residential premises under a lease agreement in private housing stock and members of a residential complex, housing cooperative, other specialized consumer cooperative before they acquire ownership of such residential premises - standard 1;

For tenants of residential premises owned by the city of Moscow, under a social rental agreement for residential premises and an agreement for the rental of specialized residential premises, who are provided with social support measures for paying for residential premises and utilities, or whose family members are provided with these measures - standard 2;

For owners of residential premises who, in accordance with the requirements of housing legislation, are obliged to pay contributions for the overhaul of common property in apartment buildings - standard 3;

For owners of residential premises who, in accordance with the requirements of housing legislation, do not pay contributions for the overhaul of common property in apartment buildings - standard 4.

Note: If, in addition to the applicant and members of his family at the place of residence, other citizens are registered in this residential building, then the standard for the cost of housing and communal services is applied, attributable to each family member, the number of which is taken equal to the number of all citizens registered in this residential building at the place of residence ( regardless of their basis of residence and whether or not they have an independent right to a subsidy).

3. The standard for the maximum allowable share of citizens' expenses for paying for housing and utilities in the total family income (approved by the Law of the City of Moscow dated November 1, 2006 No. 54 On the standards of the city of Moscow used in determining the rights of citizens to provide subsidies for paying for housing and utilities services

On September 14, the head of the Ivanovo region, Stanislav Voskresensky, signed a resolution establishing regional standards for the cost of housing and communal services. Compared to the previously established (at the end of January this year) standards, the amount of new standards increased by 4%.

The resolution will enter into force 10 days after its official publication, however, the applications - that is, specific amounts established for various categories of residents of the region and various types of housing - will apply to legal relations that arose from July 1, 2018.

The increase in regional standards is most likely due to the increase in tariffs for utilities from July 1.

Recall that regional standards are applied to the calculation of subsidies for the payment of housing and utilities. Citizens are eligible to receive a subsidy if the payment for housing and communal services exceeds 22% of the family budget. However, the size of this subsidy is not infinite - the regional standard sets a certain "ceiling", that is, it is the maximum amount of payment for housing and communal services, which is taken into account when calculating the subsidy.

The regional standard for the cost of housing and communal services is established for each municipality (taking into account urban and rural settlements), for different family composition 9 for citizens living alone, for a family of two and for a family of three or more people) and for various types of housing. Separate standards have been established for those who live in municipal or state-owned apartments, separate standards for residents of private houses, for residents of multi-apartment buildings who are required to pay for major repairs and for residents of MKD who do not have such an obligation (for example, the house is recognized as emergency).

An example is data for the city of Ivanovo.

From July 1, the standard for the cost of housing and communal services for those who live in apartments under a social tenancy agreement in the regional center is (in brackets is the size of the standard in force since January 1, 2018):

For citizens living alone - 3678.84 rubles (3552.52 rubles)

For a family of two, for each family member - 2847.96 rubles (2744.32 rubles)

For a family of three or more, for each family member - 2618.84 rubles (2521.87 rubles)

The size of the regional standard for owners of premises in apartment buildings who are required to pay contributions for overhaul:

For citizens living alone - 3657.39 rubles (3531.07 rubles)

For a family of two, for each family member - 2834.31 rubles (2730.67 rubles)

For a family of three or more, for each family member - 2607.14 rubles (2510.17 rubles)

The size of the regional standard for owners of premises in apartment buildings who are not required to pay contributions for overhaul:

For citizens living alone - 3446.19 rubles (3319.87 rubles)

For a family of two, for each family member - 2699.91 rubles (2596.27 rubles)

For a family of three or more, for each family member - 2491.94 rubles (2394.97 rubles)

The size of the regional standard for owners of individual residential buildings:

For citizens living alone - 2083.68 rubles (2003.92 rubles)

For a family of two, for each family member - 1505.76 rubles (1449.04 rubles)

For a family of three or more, for each family member - 1339.88 rubles (1289.92 rubles).

The size of the standard for the cost of housing and communal services has been establishedin the Moscow region per 1 sq. meter of total housing area per month in an apartment building for owners of residential premises,for users of residential premises of state and municipal housing stocks, tenants under rental agreements for residential premises of private housing stock and members of housing cooperatives for 2018 and for the planning period 2019-2020 and also per family member per month for families of different sizes and a citizen living alone, differentiated by municipalities of the Moscow region.The sizes of the standards apply to legal relations that arose from January 1, 2018.

RESOLUTION

ON ESTABLISHING STANDARDS FOR THE COST OF HOUSING AND UTILITIES

OF SERVICES IN THE MOSCOW REGION FOR 2018 AND FOR THE PLANNING PERIOD

2019-2020

In accordance with the Housing Code of the Russian Federation, the Rules for the provision of subsidies for the payment of housing and utilities, approved by Decree of the Government of the Russian Federation of December 14, 2005 No. 761 "On the provision of subsidies for the payment of housing and utilities", Law of the Moscow Region No. 110/2007 -OZ "On empowering local governments of municipal districts and urban districts of the Moscow Region with state powers of the Moscow Region to organize the provision of subsidies for the payment of housing and utilities to citizens of the Russian Federation who have a place of residence in the Moscow Region" and the Methodology for calculating regional standards for the cost of housing public utilities, approved by Decree of the Government of the Moscow Region dated January 23, 2014 No. 4/1 "On the Methodology for Calculating Regional Standards for the Cost of Housing and Communal Services", in order to provide citizens of the Moscow Region with subsidies for paying for housing and utilities The Government of the Moscow Region decides:

1. Establish the size of the standard for the cost of housing and communal services in the Moscow Region per 1 sq. meter of total housing area per month in an apartment building for owners of residential premises for 2018 and for the planning period 2019-2020 in accordance with Appendix 1 to this resolution.

2. Establish the size of the standard cost of housing and communal services in the Moscow region per 1 sq. km. meter of total housing area per month for users of residential premises of state and municipal housing stocks, tenants under rental contracts for residential premises of private housing stock and members of housing cooperatives for 2018 and for the planning period 2019-2020 in accordance with Appendix 2 to this resolution.

3. Establish the size of the standard for the cost of housing and communal services per family member per month for families of different sizes and a single citizen, differentiated by municipalities of the Moscow Region, in an apartment building for owners of residential premises for 2018 in accordance with Appendix 3 to this resolution.

4. Establish the size of the standard for the cost of housing and communal services per family member per month for families of different sizes and a single citizen, differentiated by municipalities of the Moscow Region, in a residential building of an individual housing stock for owners of residential premises for 2018 in accordance with Appendix 4 to this resolution.

5. Establish the size of the standard for the cost of housing and communal services per family member per month for families of different sizes and a single citizen, differentiated by municipalities of the Moscow Region, for users of residential premises of state and municipal housing funds, tenants under contracts for renting residential premises of private housing fund and members of housing cooperatives for 2018 in accordance with Appendix 5 to this resolution.
