b) appendix to the said Basic Provisions shall be supplemented with paragraph 7.15.1 of the following content:
“7.15.1. There are no identification marks that must be installed in accordance with clause 8 of the Basic Provisions for the admission of vehicles to operation and the duties of officials to ensure road safety, approved by the Decree of the Council of Ministers - the Government of the Russian Federation of October 23, 1993 No. 1090 "On the rules road traffic".
What did it change? The SDA has essentially two sections on the technical condition of cars:

  • The list of malfunctions in which the operation of the vehicle is prohibited
  • Basic provisions for the admission of the vehicle

The difference between these two sections is simple. If the car does not comply with the basic provisions for admission - this is certainly bad, but not punishable. If something from the list of malfunctions suddenly breaks down, then there may already be a fine. Moreover, for some breakdowns, deprivation of “rights” and a fine. (I will not bore you with these subtleties in this text, whoever wants to study it himself, then we look at articles of the Code of Administrative Offenses 12.5. and 27.13.).
If something “other” broke down (not the color of the lights, the brake system, the steering), then a fine under article 12.5. Code of Administrative Offenses of the Russian Federation.

Article 12.5. Driving a vehicle in the presence of malfunctions or conditions under which the operation of vehicles is prohibited, or a vehicle on which the identification mark "Disabled" is illegally installed

1. Driving a vehicle in the presence of malfunctions or conditions under which, in accordance with the Basic Provisions for the admission of vehicles to operation and the duties of officials to ensure road safety, the operation of the vehicle is prohibited, with the exception of malfunctions and conditions specified in parts 2 - 7 of this article,

shall entail a warning or the imposition of an administrative fine in the amount of five hundred roubles.

So now about the changes: in those same "basic provisions" they added the obligation to comply with "identification marks" and automatically there was a fine of 500 rubles for this!

It's time to quote what these signs are:

8. Vehicles must be marked with:

"Road train" - in the form of three orange lights, located horizontally on the roof of the cabin with gaps between them from 150 to 300 mm - on trucks and wheeled tractors (class 1.4 tons and above) with trailers, as well as on articulated buses and trolleybuses;

"Spikes" - in the form of an equilateral triangle of white color with the top up with a red border, into which the letter "Ш" is inscribed in black (the side of the triangle is not less than 200 mm, the width of the border is 1/10 of the side) - behind motor vehicles with studded tires;

"Transportation of children" - in the form of a yellow square with a red border (border width - 1/10 of the side), with a black image of the symbol of the road sign 1.23 (the side of the square of the identification mark located in front of the vehicle must be at least 250 mm, at the rear - 400 mm);

“Deaf driver” - in the form of a yellow circle with a diameter of 160 mm with three black circles with a diameter of 40 mm applied inside, located at the corners of an imaginary equilateral triangle, the apex of which is turned downwards - in front and behind motor vehicles driven by deaf-mute or deaf drivers;

"Training vehicle" - in the form of an equilateral triangle of white color with the top up with a red border, into which the letter "U" is inscribed in black (side not less than 200 mm, border width - 1/10 of the side), - in front and behind mechanical vehicles means used for driving training (it is allowed to install a two-sided sign on the roof of a car);

"Speed ​​limit" - in the form of a reduced color image of road sign 3.24 indicating the permitted speed (sign diameter - at least 160 mm, border width - 1/10 of the diameter) - on the rear side of the body on the left of motor vehicles engaged in organized transportation of groups of children transporting bulky, heavy and dangerous goods, as well as in cases where the maximum speed of the vehicle according to the technical characteristics is lower than that specified in clauses 10.3 and 10.4 of the Rules of the Road of the Russian Federation;

"Dangerous Goods":

  • when carrying out international transportation of dangerous goods - in the form of a rectangle measuring 400 x 300 mm, having an orange reflective coating with a black border no more than 15 mm wide - in front and behind vehicles, on the sides of tanks, and also in established cases - on sides of vehicles and containers;
  • when carrying out other transportation of dangerous goods - in the form of a rectangle measuring 690 x 300 mm, the right side of which is 400 x 300 mm in size, painted orange, and the left side is white with a black border 15 mm wide - in front and behind the vehicles.

On the identification mark are applied designations characterizing the dangerous properties of the transported cargo;

"Oversized cargo" - in the form of a shield measuring 400 x 400 mm with red and white alternating stripes 50 mm wide applied diagonally with a retroreflective surface;

"Slow-moving vehicle" - in the form of an equilateral triangle with a red fluorescent coating and with a yellow or red retroreflective border (triangle side length from 350 to 365 mm, border width from 45 to 48 mm) - behind motor vehicles for which the enterprise - the maximum speed is set by the manufacturer to be no more than 30 km/h;

"Long-length vehicle" - in the form of a yellow rectangle with a size of at least 1200 x 200 mm with a red border (width 40 mm), having a retroreflective surface - behind vehicles whose length with or without load is more than 20 m, and road trains with two or more trailers. If it is impossible to place a sign of the specified size, it is allowed to install two identical signs with a size of at least 600 x 200 mm symmetrically to the axis of the vehicle.

"Beginner driver" - in the form of a yellow square (side 150 mm) with a black exclamation mark 110 mm high - behind motor vehicles (with the exception of tractors, self-propelled machines, motorcycles and mopeds) driven by drivers who have the right to drive these vehicles less than 2 years old.
At the request of the driver, identification marks can be installed:

"Doctor" - in the form of a blue square (side 140 mm) with an inscribed white circle (diameter 125 mm), on which a red cross is applied (height 90 mm, stroke width 25 mm), - in front and behind cars driven by medical drivers ;

"Disabled" - in the form of a yellow square with a side of 150 mm and the image of the symbol of the road sign 8.17 black - in front and behind motor vehicles driven by disabled people of groups I and II, carrying such disabled people or disabled children. The identification mark "Federal Security Service of the Russian Federation", which is a conditional identification mark, in the form of two lights with blue lights operating in a flashing mode, located no higher than the dipped beam headlights in the front of the vehicle used to ensure the safety of state protection facilities.

Question: Do I need to hang a “child transportation” sign on a car if I am transporting my own children?
Answer: The “basic provisions” themselves do not indicate in which cases the sign should be placed, but there is such an indication in the text of the traffic rules themselves. We are talking only about organized groups:
22.6. Organized transportation of a group of children must be carried out in accordance with these Rules, as well as the rules approved by the Government of the Russian Federation, in a bus, marked with identification marks"Transportation of children".
At the same time, the “basic provisions” themselves do not indicate at all who and when should put up this sign, so it is absolutely obvious that it is needed for organized groups of children, but there is no indication of whether this sign can or should be installed in other cases. If you formally read the “basic provisions” at all, then paragraph 8 begins with the words: “The vehicles must be installed” and then there is a list of signs with reservations. There is no such clause near the sign "Transportation of children" (as well as the sign "oversized cargo"). So if you read the traffic rules verbatim, then every car should have this sign. In general, on each, not even carrying children. So we can only hope for the prudence of the traffic police inspectors, as well as wait for judicial practice. With a high degree of probability there will be no claims for this sign to ordinary cars (not organized groups).
Question: Can I be fined for placing a “Child Transportation” sign on my car?
Answer: Please note that the sign must be located at the FRONT of the vehicle and not on the rear window. So you can place anything on the back, but these are just advertising stickers, and not what is required by traffic rules. But if you place such a sign on the windshield, then the inspectors can already remind you that in the same basic provisions it is forbidden to place “Additional items or coatings have been applied that limit visibility from the driver's seat. » The reminder will cost 500 rubles! Question: And if I don’t remove the “thorns” sign in the summer, will there be a fine?
Answer: There is no direct prohibition, so I cannot predict how the inspectors will behave in this case and how the judicial practice will go. In the Code of Administrative Offenses there is only one penalty for an extra sign from this series (Article 12.5, Part 4.1.) - this is the illegal installation of the “Disabled Person” sign. Logically, it turns out that all the rest can be “illegally installed” without any punishment. But on the other hand, the traffic police and the courts may consider that since the “spikes” sign is not installed as indicated in these “basic provisions”, then this is formally a violation. We will wait for judicial practice, and I have no doubt that the traffic police will try to create such a practice.
Question: I bought myself a Spikes sign at a gas station and put it on my car. Now there will be no penalty?
Answer: I have not seen something in the sale of signs that meet the requirements for size. Pay attention to the fact that in the "basic provisions" the dimensions are indicated - 200 mm (20 cm, if someone does not translate it themselves). Take a ruler on the table and measure 20 cm. And now remember the size of the signs that they sell at gas stations!
Question: My rear window is tinted and I can't see it when I put the badge on. Is this a violation?
Answer: Formally, you have fulfilled all the requirements. Back sign. There are no requirements for visibility in the traffic rules. True, there is a risk that the inspector will also do it “formally” - take a picture of your car from the back as evidence from the outside and then it will be difficult to prove that “the sign was, but was not visible.” Let me remind you that you can stick not only on the glass, but anywhere "behind"!
Question: Do trucks also need to have spikes on them?
Answer: Certainly! On all motor vehicles. At the same time, the truck has a "rear" - it will apparently not be glass, but a body.
Question: If I ride a bicycle with studded tires in winter, do I also need to put up a “studded” sign?

The rules of the road (clause 8 of the "Basic Provisions on the Admission of the Vehicle for Operation") provide for 11 warning (identification) signs that the driver must stick to his vehicle. They are used to designate vehicles of the respective categories.

These are the following signs:

  • "Spikes" - pasted on the back of vehicles moving on studded tires. It is a white equilateral triangle with a red border, in the center of which a black letter "Sh" is inscribed. In accordance with the requirements of the SDA, the side of the triangle must be at least 20 cm, the width of the red border must be at least 1/10 of the side;
  • "Beginner Driver"- is pasted on the back of vehicles driven by inexperienced drivers who have a driving experience of less than two years. The sign is a bright yellow square measuring 15x15 centimeters, in the center of which there is a black exclamation mark 11 cm high. The sign is not glued to motorcycles, tractors and self-propelled vehicles;
  • "Training vehicle" - this sign denotes vehicles used by driving schools for driving training. It is a white equilateral triangle with a red border, in the center of which a black letter "U" is inscribed. It is installed in front and behind the car (it can be additionally fixed on the roof of a car);
  • "Road train" - this sign in the form of three orange lights located on the roof denotes cargo vehicles with trailers, as well as articulated trolleybuses and buses (such as "accordion");
  • "Transportation of children"- is a yellow square with a red border and the image of the road sign symbol 1.23 ("Children") in the center. The size of the sign in front is at least 25x25 centimeters, at the back - at least 40x40 cm (the width of the border is 1/10 of the side);
  • "Deaf Driver"- is pasted behind and in front of vehicles driven by deaf drivers. It is a yellow circle with a diameter of 16 cm, inside which three black dots with a diameter of 4 cm are drawn (arranged in the form of a triangle looking down);
  • "Speed ​​limit"- is installed at the rear of vehicles carrying oversized, heavy and dangerous goods, as well as groups of children. It is also necessary in cases where the maximum permissible speed of the vehicle is limited by traffic rules. It is a reduced road sign 3.24 (diameter - at least 16 cm);
  • "Dangerous goods" - this sign indicates the front and rear of vehicles carrying dangerous goods. It is a rectangle measuring 69x30 cm, the right side (40x30 cm) is painted orange, the left side is white. The identification mark is marked with symbols characterizing the hazard class, the number of the hazardous substance and the code of emergency measures. When performing international transportation, a simplified version of the sign is used (a simple orange rectangle 40x30 cm with symbols);
  • "oversized cargo"- this warning sign in the form of a shield measuring 40x40 cm with white and red stripes 5 cm wide applied diagonally is applied to vehicles carrying oversized cargo;
  • "Low-speed vehicle" - is installed behind vehicles, the speed of which technically cannot exceed 30 kilometers per hour. It is a red equilateral triangle with a yellow border (the side of the triangle is 35-36.5 cm);
  • "Long vehicle"- the sign denotes vehicles whose length exceeds 20 meters (with or without cargo). A horizontal bright yellow rectangle measuring at least 120x20 cm with a red border is hung behind the vehicle.

At its discretion (if there are grounds for that), the driver has the right to install signs on his car:

  • "Disabled person" - a yellow square with a side of 15 cm and a conditional image of a person in a wheelchair. It can be installed in front and behind on vehicles driven by disabled people of the first and second groups or carrying such disabled people;
  • "Doctor" - a blue square 14x14 cm with an inscribed white circle with a diameter of 12.5 cm, in the center of which is a red cross.

Where to glue the sign "thorns" according to the rules?

Studded wheels can cause accidents because the presence of studs shortens the stopping distance of the vehicle. In order for the driver behind the car to have this information, the Rules provide for the mandatory designation of vehicles moving on studded tires.

The warning sign must be clearly visible from a distance of more than 20 meters. To do this, it is placed on the rear window of the car.

In the presence of tinting, the sign is glued from the outside. There are no specific requirements regarding the location of the sign.

The Regulations of the SDA on the admission of the vehicle to operation say that the driver is obliged to glue the “Sh” sign, however, administrative responsibility for the absence of a sign was not provided until April 2017, now the fine is 500 rubles. There is also no direct ban on the presence of the “Sh” sticker in the summer in the law.

Where to put the sign "disabled"?

The sign "Disabled" at will can be glued by disabled drivers of the first and second groups. This sign can also be used to designate vehicles transporting disabled people of the 1st and 2nd groups or disabled children (in this case, the identification sign must be removable).

According to the rules, the sign must be glued"front and rear of mechanical vehicles", more specifically, the installation location is not indicated.

The current traffic rules provide drivers of vehicles with the “Disabled” sign with a number of concessions - they can deviate from the requirements of the traffic signs “Parking is prohibited”, “Movement is prohibited”.

On which side should a novice driver stick a sign?

The Regulations of the SDA on the admission of the vehicle to operation say that inexperienced drivers (who have a driving experience of less than two years) are required to glue the sign "!" on their cars, however, administrative responsibility for the absence of a sign is not currently provided.

What penalties are provided if you do not stick a special road sign?

For the absence of warning signs on the car at the moment there are no fines. To glue an exclamation point or the letter "Ш", or not to glue - the driver decides.

The obligation is spelled out in the Regulations of the SDA on the admission of the vehicle to operation, however, there is no administrative responsibility for this kind of violation.

However, the Ministry of Internal Affairs intends to eliminate this contradiction and has already prepared a package of amendments to the SDA. If the Government approves them, violating drivers will be punished under Article 12.5 of the Code of Administrative Offenses of the Russian Federation, that is, as for driving a vehicle in the presence of malfunctions (since April 2017 a fine of 500 rubles).

In settlements, the main sign 1.23 is installed at a distance of 90-100 m, the second one - at a distance of no more than 50 m from the beginning of the dangerous area.

Requirements for the vehicle and driver

Transportation of minor passengers in traffic rules is regulated by clause 22.6. In more detail, its rules are formulated in Decree of the Government of the Russian Federation No. 1177 of December 17, 2013. Later they were supplemented with new conditions. And the requirements for transporting a group of children are much stricter than when it comes to adults:

  • the speed of transport should not exceed 60 km/h even where other cars and motorcycles are allowed to go faster by signs;
  • it is necessary to move along a predetermined route, it is forbidden to change it along the way;
  • adults must accompany children, no other passengers can be in the cabin;
  • while driving in transport, it is necessary to turn on a yellow or orange flashing beacon (the requirement was introduced on 07/01/2018);
  • additional cargo cannot be transported with children; only their own luggage and personal belongings are allowed on the bus;
  • the driver must remain in his place in the cab until the last child leaves the cabin;
  • when a bus is moving with minor passengers in a convoy, it is prohibited to overtake other vehicles;
  • under no circumstances should you drive in reverse;
  • during embarkation and disembarkation of minor passengers on the vehicle, emergency lights must be switched on;
  • children and accompanying persons during the movement must be in their seats, no one should ride standing.

Young passengers should be instructed before the trip on how to behave in transport. None of them should distract the driver with shouts, running around, etc.



In practice, if the child was not on the road at that moment, the driver is usually not punished. But in the case of an accident, the article will definitely be applied, in addition to the fact that you will have to be responsible for injuring a minor pedestrian.

Everything is more complicated with the designation on the bus carrying young passengers. In its absence, Part 3 of Article 12.23 of the Code shall apply:

Violation of the requirements for the transportation of children, established by the Rules of the Road, entails the imposition of an administrative fine on the driver in the amount of three thousand rubles; for officials - twenty-five thousand rubles; for legal entities - one hundred thousand rubles.

The decision will also be issued if there is a sign on the front glass, but they forgot to fix it on the back. Or it does not meet the standard, is not in place. The same punishment awaits the driver if his vehicle was moving in reverse even in a permitted place. And for the fact that he turned off the intended route and went the other way, let strangers into the cabin, a fine is imposed under part 4 of article 12.23 of the Code of Administrative Offenses. Its size is also 3000 r.

The symbol "Children" exists in many countries, its presence is caused by the urgent need and requirement of the Vienna Convention. The sign does not prohibit anything, but it will help the driver to avoid hitting a young pedestrian and pangs of conscience. And the child, perhaps, will save life and health.

On July 10, 2017, amendments to the Rules of the Road of the Russian Federation regarding the requirements for the transportation of children, approved by Decree of the Government of the Russian Federation dated June 28, 2017 No. 761 (), come into force.

Now, in accordance with the new requirements: transportation of children in under 7 years of age in a passenger car and a truck cab must be carried out using child restraint systems (devices) that are appropriate for the weight and height of the child. In other words - only in a car seat.

Transportation of children aged 7 to 11 years (inclusive) in a passenger car and the cab of a truck must be carried out using a car seat or using seat belts, and in the front seat of a car - only in a car seat.

In addition, according to the new rules, it is forbidden to leave a child under the age of 7 in the car while it is parked in the absence of an adult (paragraph 12.8 of the SDA of the Russian Federation).

Is it possible to use a "booster" when transporting children

Boosters can be used when transporting children if the device meets the requirements of GOST R 41.44-2005 (Russian PCT standard) and is selected in accordance with the weight and height of the child being transported. What is the penalty for improper transportation of children

Violation of the requirements for the transportation of children established by the traffic rules entails the imposition of an administrative fine on the driver in the amount of 3,000 rubles, on officials - 25,000 rubles, on legal entities - 100,000 rubles (part 3 of article 12.23 of the Code of Administrative Offenses of the Russian Federation).

Along with the transformation of the Disabled sign, legislators also looked at other signs on the car. In particular, warning other drivers that there is a special category of passengers in the car - like "Caution, there are children in the car", offering to fix a new appropriate sticker in the traffic rules. We will talk about the status of the new law of 2020 and how it will work in practice when the obligation to glue the sign on the car appears and when the innovation comes into force, we will talk below.

What is the new traffic sign?

The sign is not new at all. Caring parents have been hanging it on their cars for many years in order to indirectly ensure the safety of a child transported in a car. These are all kinds of stickers, laminated plates and others, illustrating a child and calling for caution or specifically the distance to a vehicle with such a sign.

But they want to fix the new sign in the traffic rules by law. It means that:

  • the sign "Passengers-children" in the car will have a single standard, including dimensions, images, edging, material of manufacture, as well as the method and location of installation (rear and / or front),
  • drivers may be required to install such a sign on a mandatory or optional basis.

As for the prescription itself, a new sign with a warning about children in a car will be added to the Basic Regulations for the admission of vehicles of the SDA 2020, which now lists the plates regulated for installation on a car in certain cases: Disabled sign, deaf driver, training vehicle , slug and others.

Please note that for 2020 this Appendix to the SDA already has something similar - the transportation of children. But this sign should not be confused with the new one about child passengers. The first one is used only for organized transportation of children (by bus) and has existed since 2008.

There is no photo of the new sign about the child in the car yet, because it has not yet been developed. The traffic police only put forward a proposal to bring the image to a common standard and regulate the installation procedure.

When are drivers required to install?

Never. According to the proposal received from the traffic police, the new sign "Passengers-Children" will not be mandatory for installation, but will only be advisory in nature.

Thus, when a change appears, it should not be included in paragraph 8 of the Basic Provisions, but the innovation should be separated from this paragraph, since it lists signs that are mandatory for installation on a machine in certain cases.

It also doesn't specify things like:

  • the age of the child to be transported by the new sign,
  • location of the plate (front or rear).

Motorists will not be required to install the “Passenger-children” sign, it will be created as a standardized version of the warning about a child in the car, the installation will only be advisory in nature.

When will it take effect?

This is also unknown. As we mentioned above, the new sign about children in the car today is just a proposal from the traffic police. And it is far from a fact that it will be approved at all, and the changes to the traffic rules will come into force.

For 2020, there is not even a draft resolution on changes to the Rules. Relevant innovations are introduced into this legal act only by Decrees of the Government of the Russian Federation. A complete list of them can be found on the website of the official publication of regulations.
